Austin Capital City Comedy Club

We were invited to drive up from San Antonio to attend a show on Thursday night. Does anyone know if the Capital City Comedy Club has a 51% sign or 30.06 sign posted?

I don't know for sure, but I would expect it to be a 51% establishment.

I know i am bringing up an old thread, but i am also going to the CapCity Comedy Club in a few weeks. I figured they would be 51% and then found this thread to confirm.

However after checking myself, the TABC site says they are a BLUE gun sign. So how does that work, can an improperly posted 51% sign be ignored? can anyone confirm the current state of their signage? 51% or 30.06. I would check it out myself but I am more than 100 hundred miles away.

As for the blue sign, you should be good to go legally. If they have an improperly posted 51% sign, then you are statutorily legal to carry past it, but if you are found carrying you may have a hassle trying to prove they are not 51%.

As for a 30.06 sign, there is no entry that anyone has submitted to http://www.texas3006.com" onclick="window.open(this.href);return false;, but that does not mean they aren't posted as they just may have not been submitted by someone.

I've looked into this and the TABC regulation states that they must post the sign that matches their license. There is no provision for posting a red sign in lieu of a blue sign.

Anyone can ask to look at a liquor license and they must show it to you. You can verify that it indeed says BLUE and ask them to make their signs compliant. Point out that TABC regulations require that they post the matching signs.

If that doesn't work, complain to TABC and they will be told to fix it. I got Opal's by Fry's fixed.

The beauty of TABC signs is that they take so much space, nobody wants to go to the trouble to post a 30.06 sign also.

I disagree with this on one point. You are correct about the regulations, but there are no regulations requiring them to show the license to anyone who asks. It must be posted publicly, but the regulations do not say they must take it down and show it to you. And they do not have to allow you behind the bar to look at it more closely.

Even more importantly, I do not recommend that you or any non-officer try to enforce the regulations. It seems to me that this is a quick route to an argument and a criminal trespass warning. There are TABC agents who are paid to enforce the regulations and take those kind of chances. Since it is your tax money paying them, and I would hate to see you waste your tax money, I strongly recommend that you let them do their job.

If you see someplace that is posting a sign that does not match the license as shown in the public database, just call the nearest TABC office (or their headquarters 800 number) and file a complaint. An agent will handle the problem and you won't have any arguments. I think this is the best way to correct these problems.

Just wanted to post a follow-up. We went to the club last weekend and it is indeed the standard blue sign. There is no 51% sign at the bar and no 30.06 wording on the entrance.
