Keller, TX is near Southlake (where the Bentley-driving Tomball bad boys beat up the lady at Chick-Fil-A)
and is a suburb of both Dallas and Funkytown Fort Worth.

The neighbors were beefing about one of their dogs who was barking. One couple entered the property of
the other. The neighbor man fired apparently 1 shot at the man. The man was hit in the abdomen, then the
bullet passed through him (a FMJ apparently?) and hit his wife in the leg.

The shooter was arrested. More details will be posted here if I find anything new.

Judging by the number of charges filed against the shooter, the DA's office must be pretty sure it wasn't justifiable.

But, going into someone else's back yard during a verbal altercation almost certainly escalated the situation. It'll be interesting to see what charges stick and what the final verdict is if there's a trial.

Keller is a bedroom community 8 miles north of Fort Worth, and just east of I-35W. It has enjoyed rapid growth over the last 10 years as it is in the growth path of DFW airport, as urban sprawl has crept westward.

Here is an update from the Star-Telegram(Fort Worth):

"KELLER — An early-Sunday argument over a barking dog ended when a man shot his neighbor in the stomach, accidentally wounding his own wife as well, police said. The shooter threatened two other residents when they tried to help, police said."

It's alcohol related according to the story. I agree with SIA, that range ammo was probably used. Just a prime example of the dangers of using it for s.d. purposes. The flip side of that is the victim might not have survived if the gunman had used JHP's.

Here's another news report of the story:

BTW - I graduated from Keller High School, Ryan Froh (the victim in the story), was a year behind me, I can't place him right now, need to take a peak at my yearbook.

Doesn't sound like jumping over the fence into Edward Stewart's yard was a good idea, but the whole thing stinks though, at least from what I've read in various news stories. I've got a friend in the Keller PD, will see if I can get any more info.

Police say an argument erupted between the men and as Froh jumped the fence to confront Stewart, police say Stewart shot Froh.
If someone jumped my fence and advanced on me I would probably fear for my life and defend myself too. Words go over a fence very easy. The most obvious reason to jump a fence during a verbal argument is to escalate to physical violence.

Who knows it could be just case and justified use of force. He jumped on his fence, for what reason but to assault him. I think this Ryan is an idiot. To be a bad neighbor and then jump over the fence to attack his neighbor. I just the hope the shooter has good defense lawyer.

As one of the commenters on the news site said "Don't drink and draw."

Alcohol - it can make the white people dance, get you fired from work, or make your
macho self think you should shoot your neighbor over a barking dog - geez, Louise!

Correction to my initial post: The woman that got shot in the leg was not the victim's
wife - it was the shooter's wife!

I am a little confused why Stewart is being charged here??
We're told the victim, identified as Ryan Froh, was having a get together at his home on Ottinger Road, when his backyard neighbor, whom we're told is Edward Stewart, approached Froh, asking him to keep down the noise and to quiet his dogs.

"He's got a couple of labs, which are docile, easy going dogs. He's never had problems with them. I've never heard them bark," Rushing recounts.

Police say an argument erupted between the men and as Froh jumped the fence to confront Stewart, police say Stewart shot Froh. Partygoers also told Keller police they too were threatened by Stewart. Froh was taken by air ambulance to JPS Hospital with a gunshot wound to his stomach.
Froh was being the aggressor (jumping the fence onto Stewarts property). As someone who thinks that someone that lets their dogs bark repeatedly is a nuisance and especially at 12:30am, which is when the incident occured, I am failing to see why the police are needing to investigate this. Regardless of the circumstances, Froh JUMPED the fence to get to Stewart. I can easily say that on its face, if this happened to me (someone jumped the fence into my yard), I would have done the same thing.......as would any person. I dont understand why there is even a discussion (especially in Texas). A person AT NIGHT advanced to my property. I shot them. Case closed. The ONLY issue I could see is that the wife was hit as well.

That's what I thought, too, but I guess we'll just have to wait and see. Maybe there's more to it that we don't know yet.

Thanks for the update PUCKER. Looks like the shooter is in for a long, expensive battle. Seems like the charges were justified afterall. The shooter was trigger happy, just looking for an excuse to shoot the victim, and had to bait him into coming into his yard to shoot.

I have to disagree with Joe817 on this. The guy was dumb enough (or drunk enough) to come over the fence and be the agressor. Granted the potential victim probably had a case of liquid courage and a chip on his shoulder since he knew that if they guy came over, he would get lead poisoning. Not smart by any stretch of the imagination, but I dont see where the guy should spend a minute in jail. The neighbor came over the fence onto his property.

Now, I will tell you that I will be watching this case closely because this is a scenario that seems more realistic. Me, personally, I would have called the police on the yahoo having the party and letting his dogs bark at midnight, but I dont see where the guy did anything more than defend himself from the guy that JUMPED his fence to get to him.

Again, NOT smart on the potential victim's part to provoke a fight. Not going to question that at all, but when the other guy jumped on the potential victim's property, I would have done the same thing. We'll see how this plays out.

I am confused. Folks would still shoot someone that they had challenged to come across their fence in order to fight? That seems like a pretty-weasly way to win a fight to me.
Based purely on what I have read, the shooter instigated the whole thing by inviting his neighbor to climb the fence for the purpose of fighting. Escalating from a simple case of mutual assault that you provoked knowingly and willingly to shooting someone for self-defense just does not work for me.
Don't put me on this shooter's jury, I already have a preconceived notion of what I would suggest for the verdict.

dwayne, there's a couple of points I'd like to bring to bear:

1. The victim was invited into the person's backyard to have a fight. INVITED. It was only after the shooter said come over and we'll fight about it that the victim came over the fence. It wasn't the victim who provoked the fight. The shooter was expecting him....with a gun.....after he invited him over.
2. Both guys had been drinking, not just the victim. Someone said guns and alcohol don't mix. How true that is!

But I sure agree with you about the victim not using sense and going over the fence to be enticed into a fight. And I also agree with you that the police should have been called.

I'm a friend of Ryan and what's being told by people that were there (I was not) is that Ryan went over to the fence and repeatedly tried to apologize. The shooter repeatedly told him to come over the fence so they could fight. Then after Ryan was shot, the shooter held the gun to his (Ryan's) head and wouldn't let anybody else come over the fence to help him.

Now, even given all of this information, I still say it was stupid to jump the fence.

Also, Ryan could use your prayers if you're so inclined. They had to remove his spleen and a kidney. They do expect him to make a full recovery.
