19 yr old girl and 15 yr old boy

the below is the brief info i can find, however my concern is...
a 19 yr old girl is cohabiting with a 15 year old boy at her mothers house, they moved in with the mother and step dad in January
the 19yr old becomes "with child" when the boy is 15, and the 19 yr old is about to turn 20 in two months.
the boy just turned 16 last month, but baby is due in oct.
the only people in this debacle that knew the boy was 15, was the girl, the boy and her mother. The husband is the girls stepfather. The mother and daughter and little boy, kept the secret from the husband and his daughter who is 13.
this revelation was revealed this past weekend and the husband is a little P.O.ed, but IMO he is just as guilty for not questioning the boys age.
the two sponges I like to call them as they don't work or contribute to the household are now in new mexico with the girls biological dad and his girlfriend. He states that in new mexico the law lets the grandmother who is the legal guardian of boy, give her permission to let the 19 year old and the 15 year old SHACK UP if you will.
My question is many
does granny now liable for child prostitution or exploitation of a minor?
did the 19 yr old hold captive the 15 yr old and sexually molest/rape him?
is 19 yr old mother just as guilty for withholding the truth about age?
is the step dad equally liable?
meanwhile the state of texas has been giving the 19 yr old free prenatal care and ebt?
shouldn't EBT be notified they are out of state now and the possible
should calls be made to the new mexico leo or child protection services?

IANAL but there's no way I know of that a mother of a 15-year old boy can consent to a 19-year old woman statutorily rape that young man.

On the other hand, if you're not wanting to see this blow up in everyone's face, perhaps you'd just keep your nose on your side of the fence and keep your suspicions to yourself.

The taxpayer gets stuck with the bill on this. Figure that it costs at least $5,000 a year to send each child to school which comes from property tax, every child from a welfare home costs all of the costs of welfare plus the property tax to send the kid to school. I have seen teens at 13 pregnant that were more mature than people in their 20's so I won't comment on that. This couple does not sound like they pass the maturity test and are bound to be a burden on the taxpayer for many years to come. Otherwise I don't care what they do.

IANAL but a full reading of Texas Penal Code 22.011 makes clear that a 19 year old having sex with a 15 year old is felony sexual assault unless they are married.

thanks i have found no less than five references to 17 then to 18 on the legal age
despite the two numbers.... the girl 19 has committed the offense on a 15 yer old boy, who just turned 16

The situation now is I know, my wife knows and now my son (whose house it was happening in) knows he was only 15, even though we were all told he was 17. So the sons wife hid the facts, as did the boy and the girl.
you know lies always catch up to you, we wouldn't know at all except the boy (15yr old) and the step granddaughter (19 yr old) just had to go back to new mexico to see his gang friends, as it turns out they are staying. ..but was all upset because he stands to get some money from new Mexico for wrongful death of his drug dealing mother who died in jail in Albuquerque...last fall
and since he is under 18...his guardian (grandmother) is going to hold his cut and he is afraid it will be gone... of course we all asked why aren't you getting it..and then it came out from my daughter in law(mother of the 19 yr old) that he is only 16.....my son almost threw up he got so mad, and i just shook my head

i guess in the long run, i need to make a call to the leo and he may need to go see one as well.

Sec. 43.25. SEXUAL PERFORMANCE BY A CHILD. (a) In this section:

(2) "Sexual conduct" means sexual contact, actual or simulated sexual intercourse, deviate sexual intercourse, sexual bestiality, masturbation, sado-masochistic abuse, or lewd exhibition of the genitals, the anus, or any portion of the female breast below the top of the areola.

(b) A person commits an offense if, knowing the character and content thereof, he employs, authorizes, or induces a child younger than 18 years of age to engage in sexual conduct or a sexual performance. A parent or legal guardian or custodian of a child younger than 18 years of age commits an offense if he consents to the participation by the child in a sexual performance.

In the case of the 19 yo, she is guilty of 43.25. If the parents were aware the boy was under 18, and they were allowing the conduct, then they are guilty as well.

One thing to note, while this is the law, it is RARELY enforced in these cases of two teens consenting. It is extremely hard to prosecute because you have to get all of the participants to incriminate themselves and then convince a judge and/or jury to convict.

I didn't see where the teens were putting on a "performance". They were just having sex and I thought 17 was the age of consent for that.

Romeo and Juliet laws are only to protect the older one from sexual assault (statutory rape) charges. See TPC 22.011 in my post above. What other laws exist in states determines the actual 'age of consent'.
