Removes "knuckles" from PC 46.05.

But what is bigger news, to me anyway, is it also appears to remove carrying a "club" in public as an offense from PC 46.02. Whoa!

Here's a question, is a Baton considered a club? I have my level 4 security commission, I can legally posses it but only carry it while in uniform, so if clubs become legal and a baton is a club, I could carry even off duty?

(1) "Club" means an instrument that is specially designed, made, or adapted for the purpose of inflicting serious bodily injury or death by striking a person with the instrument, and includes but is not limited to the following:

(A) blackjack;

(B) nightstick;

(C) mace;

(D) tomahawk.

IANAL, but I believe the baton would be included in the definition of "club".

Well, by "now" I meant when the law goes into effect. The question is, does the bill allow carry of clubs in public? It appears to me that it does.

The law as it stands this moment exempt certain security personnel who are on duty from the prohibition against carrying clubs, so pretty sure the law considers batons to be clubs, along with anything else you can whack somebody with.

AUSTIN — Texas lawmakers have passed legislation lifting the state ban on brass knuckles, kitty keychains and other self defense items.

The Texas Senate gave the bill its final OK on Wednesday morning; it now heads to Gov. Greg Abbott for his signature or veto.
