Delaware: Granny too old for a handgun

#1

Post by seamusTX »

Delaware requires handgun purchases to be approved by the police, and the police apparently can deny a purchase for any reason that they pull out of their back pocket.

An 81-year-old woman was denied because she was "too old" and a woman.

After some negotiations, she eventually obtained permission.

In the ensuing uproar, it came out that the state police had been retaining records of handgun purchases indefinitely. The records are required by statute to be destroyed after 60 days.

Hopefully the police will get a severe spanking as a result.

The negotiations should have included a Civil Rights lawsuit!

IANAL, but this seems like it could have been a good equal-protection suit. That would take a lot of money, though; and the state could short-circuit it by issuing the license.

There was no license involved. In Delaware, just to purchase a handgun, you have to have permission from the police.

Permission just to buy a handgun. whoa...... :waiting:
