i think it only takes four justices to agree to hear a case. Unless the four conservative justices think they can get a fifth vote, they do not take they case. The Majority vote decides the cases to take, Roberts voting with the Libs have kept the Supremes from deciding a gun related case, they are now no longer the majority!
