I will bet they would be allowed to by law. The only reasonable suspicion they would need is to see you open carrying. Could be a real loophole for a DA that is anti-open carry to have officers checking everyone they see. That would get everyone to keep their firearms under cover again.

It would fall under officer discretion, I'm sure. And yes, some officers and/or departments would abuse it, just like some abuse the ability to disarm CHL'ers for the safety of the officer/CHL'er/public. Officers could also pull over any or every driver to make sure that they have a driver's license, but they generally don't.
Remember, in a life-or-death situation, when seconds count, the police are only minutes away.
