Any appointed or elected government official or department head who enacts or enforces a law that conflicts with the state law will personally face fines up to $100,000 and lawsuits
We need this here. Texas needs be more like Florida in this instance.

Anyone else find the comment funny? Aren't Florida's laws a lot more relaxed than ours? I think it would be fair to say that they are ahead of the curve. I don't recall any of our anti-gun legislators screaming that we will end up like Florida.

Exactly... I'd argue the reverse. Texas needs to be more like Florida! XD

Councilman David Landfair asked Dannheisser if Florida will become like Texas, "Where there are guns everywhere."

"We're there, come Oct. 1," Dannheisser said.
Um, last I checked, Florida had TWICE the number of concealed licensees as Texas... "rlol"

Actually, it is about gun rights. But you don't like that the state has taken away some of your power, so you're going to kvetch about it in the name of "public safety".

I have a brilliant idea that will keep municipalities from being sued...review your laws before October 1st! :eek6

OK - maybe I am just clueless - but what cities and/or counties in Texas have their own set of 'laws' that control weapons or ammunition? I've never noticed any difference in any of the cities or counties I've been in over the past 20+ years in Texas.
The gun law goes into effect Oct. 1 and prohibits cities and counties from regulating firearms and ammunition, leaving that solely up to the state and federal governments.

I think Texas has a state law that says counties and cities cannot enact more restrictive gun laws.

Grapevine and Plano, for starters. According to reports, both have their own version of 30.06 instead of obeying the Texas one.

I believe Florida has had firearm law preemption for quite some time. The new law puts some teeth in that, creating personal liability for officials who violate the law.

But they aren't enforceable. Texas has a "preemption" law prohibiting municipalities from adopting regulations relating to the transfer, private ownership, keeping, transportation, licensing, or registration of firearms, ammunition, or firearm supplies. There are guns everywhere in Texas? I haven't seen any when I'm out and about....

You just haven't been looking! I find them all the time just laying along the side of the road. I think they fall out of the back of big dump-trucks full of 'em headed for Mexico! :biggrinjester:

I don't know about Plano, but the Grapevine reference is to the fact that the Grapevine PD will enforce the non-compliant signs at the Grapevine Mills Mall. There isn't literally a Grapevine version of 30.06, it's just the erroneous enforcement of a non-compliant sign.

It's the erroneous STATEMENT of enforcement of non-compliant signs. So far as anyone knows, nobody has ever been arrested for it.
Nevertheless, the State laws overrule local laws. (But we need a Florida-style law where we can sue the lawmakers personally for invalid laws! :anamatedbanana )
