Public Bathroom Stall

So, I am at the local Walmart and I have to use the men's room. Sitting on the toilet with my pants down in a stall and my gun is exposed. The guy in the stall next to says he hopes I have a permit for my gun. I almost pulled out my license to show him, but I instead keep quiet and wait for him to leave.

Since OC isn't permitted until January, can I still get in trouble for displaying the gun if I am in the privacy of the stall? I apologize for the mental picture this paints.

I would suspect this would be an unintentional display of a weapon - however someone with a better understanding of the law might be able to shed more light on the fact.

I'm sorry as probably this isn't the answer that you're waiting for...but I'm having a hard time getting past the whole idea of using the men's room in Walmart for a sit down. I've never done that, but I guess that if I somehow absolutely had no other option, my gun wouldn't be down around my ankles where it has the potential for being grabbed up...and me not being in...a position to defend against that. This is I suppose how you hear stories of guys who have left their handgun on the toilet tank and forgot it.

I seriously doubt that a stall in a restroom would be considered a public place for purposes of Tex. Penal Code §46.035(a).

You could avoid the entire question by placing the gun in the "hammock" formed by the crotch of your pants in that situation. That would conceal it from view from other stalls.

:iagree: That is exactly what I do when I'm in a public restroom. It hides the gun, keeps the gun within reach, and prevents you from becoming the person on the news that left their gun on top of a toilet or on the coat hook.

As far as intentional display of a firearm, I doubt you would be convicted, but someone could certainly raise an alarm by running out of the restroom, calling the police, and screaming about a man with a gun.

There has to be thousands of similar postings on the web and I wish I could a few links as this is truly a worthy subject, or at least a major concern of many CHL'rs. Just give it some thought and you'll figure out your own way.

On a funny note, I would love to see the guys reaction (well, maybe not see it all) if you had reached down and drew your handgun so he could just see the empty holster. That's a good lesson in learning to mind your own business.

I can think of many other witty responses, but may have to filter the content for this forum.

Question. I was waiting to use the urinal at a Tx rest stop. All of the sudden an elderly gentleman kicks his pistol and out it flys from a stall. I go over and pick the pistol off the tile. The elderly man comes out, I ask to see his CHL, I hand over his pistol after seeing his card. Another guy standing in line mKe a big production about calling a Police Officer. I told him everything was under control and that I an Officer. I am an officer of 3 corporations. I never claimed to be a Police Officer. Just wanted the situation to end easily for the embarrassed older man. Pushing it?

EWWWWW! :shock: I wouldn't even go INTO a Walmart restroom without full HASMAT gear on.
