CHL am i in or out

#1

Post by tlane »

So I did the class for LTC and went through registration process. I uploaded all documents needed now I am waiting for my fingerprint appt. on the 28th. Question is I have been arrested for driving without a license but I have no idea when and any other minor infraction I have no clue about since it was minor and have never had an issue with it. I marked no on criminal offences since I have no info on them. Will this disqualify me or will they just pull my record and I will be ok as long as no class a or b misdemeanors.

This may come off rude, but how were you arrested, and "other minor infractions" that you have no clue about? You were there when you got arrested right? I vote it is up in the air in your case. For the record, driving without a license is a criminal offense in texas, so you probably should of checked yes on that box. The state doesn't care if you don't have info on it, they care about if they do. It is up to you to keep track of your stuff. Sorry if I'm offending you but it is what it is.

Edit: I may be incorrect on it being a criminal offense. Seeing conflicting info on this. From what I can find though you shouldn't have been arrested. Was this in texas?

You don't remember when you were arrested? Crap, I'd remember if that happened to me.

Honesty is always the best policy. Even if you don't remember the dates, you have an obligation to answer the form honestly. Check "yes" and let the DPS decide what they want to do. If they want documentation you will need to obtain whatever court documents for the disposition of the case. On the other hand, they may decide that it was so long ago it doesn't factor in.
If you're standing still, you're loosing.

I too have a couple of arrests... one for an unpaid speeding ticket and one for a public intoxication. The former more than 30 years ago and the latter about 20 years ago. I do not remember nor do I have any records of the exact dates since both involved just paying the ticket. I.e., No court appearance, etc, etc. I did not put these on my app because I didn't have the information to put them there.

I called and asked if I needed to amend my app to include these and they said, no, that those aren't serious, or something to that effect. But they also said that if they needed something from me they would let me know. If I have to provide them my recollection then I will. If I have to contact the counties where this occurred to get some final disposition then I will.

I'm coming up on my 30 day mark since I submitted my app. I expect to either get approved soon or to get a letter requesting more info.

You should be fine as long as it isn't a class "A" or "B" misdemeanor or a felony.

Call me the bad guy but I'm disappointed that you didn't read the instructions, look online for clarification, research your own arrests before submitting. Now your application will potentially cause delay for others.

I do hope you spend a lot more time on here researching and learning before carrying.

b4aftr,

thank you for the life lesson and lecture. Some of us hadn't found this board before we submitted our apps. And just weren't sure what to put there. If our app is found to be in error it will be fixed. It may be as simple as contacting the county to get a record or, maybe, we will be denied. that is on us and not you.

the OP asked a simple question. I think he would prefer an answer from someone with similar experience and not get lectured.

Regards,

I would recommend that you contact the county that you were arrested in and ask them for the arrest record. If you were arrested then you will be able to retrieve the record, unless it occurred a long, long time ago in a galaxy far away.

If you are able to retrieve the record then I would contact the DPS and talk to a licensing agent about your situation. If you aren't able to retrieve a record then you likely have nothing to worry about.

Sorry that I didn't answer your original question.

Not rude at all. I was going to work out of state quite a bit and had received a ticket in the mail that I assumed my spouse paid. On another work trip I was pulled over due to insurance lapse and was informed my license was suspended for nonpayment. They took me to a holding facility and the spouse came down and paid the amount and it was over with. Then a year later I was informed by mail that I had a warrant for the same incident. I called and they said that I needed the receipt that I paid the court before. My spouse did not have the paperwork so I had to pay again for the same exact infraction. Since the second one was a pay the fine I don't know what dates to put on it. I was not as mature as I am now and kept no records of anything. Now that I am older I do keep track.

I know it should be remembered but I was going out of state for work at the time and was only in a holding cell for 3 hours until the wife paid the fine. I would be more than willing to provide all paperwork however trying to get information is literally like pulling teeth from a toothless man. I do my best to have no interaction with the law and I am unaware of how they work or what to do or where to go. So hopefully if DPS does get a hit on something they can provide direction

I did do as much research as I could and was asking something that is not well known. I did not think about a messaging board until after it was to late. I asked a neighbor for insight as well since he is a current CHL and went off that advice. I don't want my application to delay others and if I found someone that it directly affected I would apologize and provide compensation. I will take your advice on spending more time researching and learning before I carry. Knowledge is great to have.

I am a different kind of person and feel that the lectures can provide positive information and insight. I am thankful for both the lectures and the answers.
