MD and NJ

#1

Post by Cap'n »

We need to drive from Austin to NJ to visit my mother. I won't be able to carry in MD or NJ.

Can anyone tell me how I can legally transport handguns in MD and NJ?

I'd assume unloaded, separated from ammunition, and locked in the car's trunk.

Many thanks ... not looking forward to the trip or this issue.

Federal law says you should be able to carry an unloaded, cased weapon during interstate trips, but New Jersey authorities do not respect that. They also have restrictions on magazine size.

They also have restrictions on when, where, and why you can possess hollowpoint ammunition.

I didn't have time to look this up earlier, but here's an example of how horrendous they are: http://www.anjrpc.org/fopalawsuit.htm

A man was flying from Utah to Pennsylvania with a handgun in his checked luggage. He had to change planes in New Jersey. The airline screwed up his luggage, and he ended up in the pokey for possessing a handgun without a state license.

Federal transportation laws state that you can carry an unloaded secured firearm from any location where you can legally possess a firearm to another such location. You stated that your destination is in New Jersey. Unless you have a New Jersey Firearm Owners ID, it is not legal for you to possess a firearm in New Jersey, so the Federal transportation statutes do not protect you.

Many in similar situations advocate leaving your SD pistol at a gunshop just outside of NJ for "professional cleaning" during your stay in NJ. You could pick it back up on your way home. This would obviously have to be arranged prior to the trip.

IANAL, so take everything I said with a grain of salt. Good luck and stay safe!
Remember, in a life-or-death situation, when seconds count, the police are only minutes away.

Correct. If you can't possess it at your destination, then the Firearm Owners Protection Act (FOPA) doesn't apply.
