Three males and possibly a female robbed at gunpoint a man mowing his yard of $12 and debit card approximately 8:15pm. Thirty minutes later they tried to rob another man watering his yard. This man was open carrying, (clumsily!) drew his pistol; the robber holding a gun ran away, but the other one simply walked back to his car and was driven away.

Police spotted the car 15 minutes later and a chase ensued. The car crashed into an industrial gate and the three males ran away on foot, trying to jump fences into neighboring backyards. Police caught one; the other two (brothers) jumped into a backyard and were confronted by a third man who was armed and fired twice, striking one of the two in the abdomen (critical condition but expected to survive). The uninjured robber fled, but surrendered to police shortly afterward.

The third homeowner was arrested by police and charged with "shooting with intent to kill" (apparently it's an Oklahoma thing; I have seen that charge in OKlahoma before). Homeowner is in jail on $75K bond while DA reviews case.

John Correia of Active Self Protection reviews the second attempted robbery, which was caught on the homeowner's security video.



I have seen the paddle holster mix-up happened in training sessions. In one instance the defender drew, the holster came out still on the gun, and he "snapped" his arm/wrist trying to shake the holster free. Instead he lost control of the gun and it went flying yards away.

It was pretty dumb to get involved with Police already chasing down the bad guys. I think the home owner is in some serious trouble now. The guy he shot is probably going to sue him on top of it all. I don't get why folks don't just let the cops do their job. It would never enter my mind to get in the middle of a police chase.

Remind me to never shoot anyone center mass in OK. Maybe I will just try and wing them like Roy Rogers. Better yet never go to OK.

I don't think the problem is where on the body he shot him, more of "what were the circumstances under which he was shot?"

It does appear that the "police chase" came to the homeowner. The specific facts will be important. If the junior fence jumper had anything in his hand(s) that could be seen as a weapon, etc.

Committed an armed robbery, gets shot while running from the police, so he was a fleeing felon?

Any law can be misinterpreted and prosecuted wrong by an overzealous DA.

Cook said that he heard what sounded like gunshots being fired toward officers, so he got his gun. However, officials say there have been no reports of gunshots that night besides when Cook fired his weapon.
If the home owner turned into a vigilante, that could be a reason for the charges. It is also possible that he was in sight range of the police officers when he fired. If there weren't any other gunshots, it may be another case where your story has to match the facts to stay out of jail.

Based on the story, it does look like the home owner doing the shooting did just that. Became a vigilante to "help" the police. We shall see how it all shakes out.

Sounded like he didn’t answer the police questions and decided to remain silent. The police officers at the scene then arrested him and the DA is deciding what to do.

Better if he stayed inside with the doors locked.

If he’s front shot, probably ok. But yeah civil suit for his homeowners insurance.

And this is EXACTLY the right thing to do. You may get arrested for it, but opening your mouth cannot help you in the long run.

Remember, DAs are generally immune from being liable for screwing up like other attorneys, unless it is really really bad.
