Re: Purchase requirements in Texas???
When buying from a dealer, you have to fill out a forum that is called a 473. If you don't have a CHL, then the dealer calls the FBI to have a Brady background check run (a/k/a NICS). If you have a CHL, the NICS check isn't done.
When buying from an individual, there is no 4473 completed and no NICS check.

If you are 18+ years in TX....face to face sale of property = cash and a handshake
Any age getting a firearm thru a dealer is a 4473...period

True dat, but it is a secret handshake, and you have to know it or you can't buy.WarHawk-AVG wrote:If you are 18+ years in TX....face to face sale of property = cash and a handshake

Re: Purchase requirements in Texas???
Sorry if I seem a bit dense, even after reading this thread, but I really want to make sure I'm following the law...
Here's my situation. I'm working on my CHL, Took the class, submitting my packet tomorrow. I got to talking to a friend here at work who already has his CHL. He's got a Glock 27 he said he would sell to me if interested. I am and it's a pretty good deal. Legally, when buying from an individual, do I have to register the gun's serial number or anything with the state? I didn't think to ask during the class because most people are really hanging on tight to their handguns and I didn't think I'd be able to buy one from an individual I trusted.
What law number would I reference to show my wife I'm legal. She seems even more concerned than I.. :)
Thanks,
Mark

Re: Purchase requirements in Texas???
If you're old enough, not a criminal, and not drunk at the time of the sale, buying a handgun from an individual is the same as buying a mountain bike from an individual. The law to quote to your wife is section 46.06 of the Texas penal code.
Those who cannot remember the past are condemned to repeat it.

You are legal. You are buying from an individual. There is no registration in TX.
Give him money. Take handgun from him. Shake hands. Done.

mtbiker, you ain't from around these parts, are ya??
Relax. You're in God's Country now.
We ain't free, but we're closer than a lot of other places.
As others have said, if you wish to buy from an individual, all it takes is a willing seller and a buyer with the correct amount of cash.
The law only says you cannot knowingly sell a firearm to someone who cannot legally own one - a minor, a felon, a certified nutcase are 3 such prohibited persons.
As a seller you are under no requirement to check out every buyer. Just use common sense.
And if a buyer has a CHL, that's all you need to know.
Buy the Glock if that is what you want.
IANAL etc

LOL, Actually I am, lived in Texas for 12 years, but haven't looked into buying a pistol until now. Growing up hunting my gun's were always given to me, and I haven't hunted since I moved here so I haven't looked into gun laws until recently, and even at that is was all based on laws about carrying, not the actual purchase. I just assumed I'd by the gun from a dealer and they'd handle all the legalities.Rex B wrote:mtbiker, you ain't from around these parts, are ya??

One thing I've learned, and learned the hard way is to always VERIFY what poeple tell you about the Law. (Like, in the the State of Texas you CAN get two tickets in the SAME day for not having a current inspection on your car! :)) I was amazed to learn at the CHL class this weekend the amount of wrong information I've received from current CHL holders. I guess they just aren't keeping up on the laws.
Great info! Thanks for the help.
Re: Purchase requirements in Texas???
Problem you have is that you are looking for a "law" that doesnt exist. What law says you can fly kites? Most laws I am aware of on firearms are rules against things, not statements allowing things. There are a lot of discussions on this board about what is allowed because there are no codes listing all the things you can do, that would make the IRS codes look like Cliff Notes in size. Best things is check to see if it is prohibited then go from there. As others said, there are no laws regarding FTF except what was mentioned already.
