I thought about that after I sent the email to the mall. I'm going to send every company within the mall an email as well.

Can I ask a question? Why would anyone willingly go to the mall? There are SOOOO many choices...and for me, it is NOT the mall.

I wish that were the case, not so many options here in Longview. If I want a new pair of Oakleys, the mall is the only place around that sells them. If I want tools from sears, thats the only one. I hate the mall to begin with, but occasionally I have the need to go there. I'll figure something else out now.

Well, I think I have given my opinion before, but I will do it again. The mall entrances are posted because it is the mall banning. The anchor stores are not posted because the stores are not banning. In most cases, the anchor stores are actually separate premises (for example, the Sears store at Central Park Mall in San Antonio was built by Sears and not the mall - when the mall was torn down, the Sears remained).

If you enter through the store, you might have a defense the first time. But, especially after publicly posting that you have received the notice, if you enter through a store just to avoid the posted entrance, you are breaking the law and would be convicted. The law says if you have received the notice, and then defines what the notice will consist of. You have now admitting receiving the notice.

As with others, I try to avoid going places that are posted since I don't want to financially support places that ban. In cases like this, I might advise the anchor stores (or other stores I patronize in the mall) that I can no longer patronize them because I will not enter the mall. The mall will stop posting when their customers (the tenants) demand it.

Great idea! And don't forget to send that letter also to the management company that manages the mall for those owners. ;-) The voices WILL be heard!

IANAL, but it seems you have shot yourself in the proverbial foot twice now regarding your ability to ever carry at this mall while 30.06 is posted at ANY entrance.

1. as stated previously, your posting on a public board that you know that 30.06 is posted at some entrances ... so the "it wasn't posted at Sears and I didn't see it at the main mall entrance" argument won't fly if you ever had to go to trial.

2. you've written to the mall to voice your displeasure with their 30.06 decision. Thus now THEY know that YOU know. You have effectively given up ANY chance of carrying legally inside that mall regardless of any loophole, perceived or otherwise.

I am not planning on going back to this mall, ever. When I publicly stated that I entered through Sears I also stated that I was unarmed which I was unarmed. I wanted to see if the signs were there. I was more or less posing this question to see what everyones thoughts on the subject were. I am very careful about what I do and where I carry. If there is even a question as to whether I am allowed to or not I err on the side of caution and leave it in the car or find somewhere else to take my business. I want them to know I know and I want them to know that they have lost my business as I will not support a business who isn't gun friendly.

Internet, hire a kid, send the wife (expensive option BTW), bribery, extortion...all of these are options....Or just go nekkid...My last mall visit was when I was a recruiter in the Music City Mall (where did it get that name from?) in Odessa, Texas. Like Iraq, Afganistan, Kyrgystan, other classified Stan's, I left nothing in Odessa that was important enough to me to go back for...

Dear Longview Mall management,

It is extremely heartening to know that you are keeping the publics safety and security near and dear to your hearts...I am glad that you have taken steps to ensure the absolute freedom that criminals and others with harmful intent will be unmolested by the public while in your facility, and that you have taken steps to thoroughly take responsibility for the lives and health of your patrons...

Unfortunately, I cannot risk the lives of my family and friends by your thoughtful actions, and will be taking mine, and as many nieghbors and friends as I can muster to other businesses in and around the great city of Longview...Remember Canton, Texas is not that far away, and (if I recall correctly) that there is this (ironic) statue of people swapping a rifle at the main entrance to that property...

Again many happy returns, and I hope you have at least one more prosperous and fiscally positive Christmas season this year...

Maybe after all is said and done you will realize the err of your ways, and understand that your CHL patrons are not the problem, nor are they a threat to anyone other than the criminals and other malcontents who prey upon your valued customers...

This is the basic "form" letter I send to business that require it....

Upon attempting to shop at your store, I noticed that you have it posted 30.06, disallowing the carry of concealed weapons by CHL license holders.
Acknowledging that your reasoning is to insure the safety and security of your customers and employees, I have only one question:

Who are you protecting these people from? As a CHL holder, I have been cleared through multiple background checks from both local law enforcement and the FBI.
People who hold CHL licenses are just the type of folk you should want in your stores. However, as it appears that you do not want me in your stores, I will gladly comply by taking my business, as well as others, elsewhere.

When HB2909 passed in 1997 creating TPC §30.06, we succeeded in establishing a requirement for a "big, ugly sign." The vast majority of property owners who would post a small "no guns" sign won't even think of posting a 30.06 compliant sign because it just looks terrible on their building. If we were to reopen the 30.06 sign issue, especially in the current political climate in Austin, I think we wouldn't like the result. It's far more likely that the "big, ugly sign" would be replaced with something much smaller and only require English. This would be the trade-off for requiring a small, less-intrusive sign at every entrance.

There has been a lot of turnover in the Legislature since 1997, but those who are fully educated about this issue know we really pulled off something good for CHL's and not so good for anti-gun property owners. There would be no support for a stand-alone bill to repeal it, or even change the sign requirement, but if we opened the door, then tweaking it would be much more palatable.

The bottom line is 1) there are very few compliant 30.06 signs; 2) if you know the property is posted with a 30.06 compliant sign then you have received effective notice and can be prosecuted; and 3) proving you are aware of a 30.06 compliant sign may or may not be difficult to prove by the property owner.
