Lake O' the Pines question

Lake O' the Pines question
Hey all,
A buddy of mine and I are planning to camp at Lake o' the Pines this weekend, so of course I wanted to be in the clear when it came to my CHL. I have to admit that I'm a little confused, though. The lake doesn't seem to meet any of the prohibited locations listed in my CHL handbook, but on their website they include the following section on firearms:
327.13 Explosives, Firearms, Other Weapons and Fireworks
(a) The possession of loaded firearms, ammunition, loaded projectile firing devices, bows and arrows, crossbows or other weapons is prohibited unless:
(1) in the possession of a Federal, state or local law enforcement officer;
(2) being used for hunting or fishing as permitted under Section 327.8, with devices being unloaded when being transported to, from or between hunting and fishing sites;
(3) being used at authorized shooting ranges; or
(4) written permission has been received from the District Commander.
(b) Possession of explosive or explosive devices of any kind, including fireworks or other pyrotechnics, is prohibited unless written permission has been received from the District Commander.
So how does one proceed? Can I carry? If not, can I leave my pistol in my truck, which will be parked at the campsite? Forgive my ignorance on this, but it wasn't covered in class.

No - according to the Corps Office of Counsel (da lawyers) - the CFR prohibits anyone from possessing a firearm (licensed or not) on Corps lands unless lawfully hunting. I will be out there this weekend and if I catch you I will 'have' to provide you a citation. We do have LEO patrol assistance BTW. It could ruin your weekend.
The reason you don't see it in your handbook is cuz it is a state law. Lake of the Pines is Federal property. Federal laws, federal regulations - see other threads on these discussions.
Now - having said what I said - there are some that still tend to disagree with the Corps interpretation of its regulations. Do whatever is in your heart.

Forgive me but I don't like you attitude. I truly hope you had your tongue firmly planted in your cheek and was halfway making humor. I am sure there are real live bad guys you could be looking to catch rather than making threats toward the good citizens of Texas who carry hand guns.

Eh, he's just doing his job. The law's the law, whether we agree or disagree with it. I don't like being unarmed any more than you do, but I would like to get some lake time in before my (final!) college semester starts.Diode wrote:couzin wrote:. Short of a Federal Courthouse there is no reason we should not be able to carry on Federal Property. Sheesh! Look at al lthe Post Office threads we have seen, I still can figure out what the Feds think......maybe they can go write a few more laws, that should do the trick. I absolutely agree with you, no need to apologize for speaking your mind. I got the answer to my question, so the rest of the thread is open for discussion. I'm like most people here, I cringe a bit at having to jump through so many hoops to practice my right in the first place, but that's the breaks. Only thing I know to do is keep trying to elect gun-friendly pols and write, write, write. Maybe one day the silliness will end.Diode wrote:

according to the CHL page at TSRA.com:
On July 8, 1998, Executive Director, Andrew Sansom signed Executive Director Order No. 98-001 which reads as follows:
Nothing in the Public Hunting Lands Proclamation or State Parks Proclamation prohibits a person from possessing a concealed handgun, loaded or unloaded, under the authority of a concealed handgun license issued by this state or any other state. Persons carrying concealed handguns must comply with all concealed handgun laws.
The Executive Director reserves the right to prohibit the carrying of all firearms during certain events or in certain locations on Departmental lands.
This order is issued pursuant to Title 31, Texas Administrative Code, Sections 59.134 (f) (1) and 65.199, and is effective immediately. "

My attitude has been called into question by many way up the command chain, and by just as many down the chain. It is what it is by your interpretation. i was just informing the guy that the regulation is enforced - that is all. SHOULD I encounter an individual that has a weapon, then my duty is clear - however I should chose to deal with it. That being aside from nothing, I did not make any "threat" to anyone. Don't like my response - I have an attitude - fine - plenty of other lists and or forums to go to and I will leave you to this one. Bye!Diode wrote: Oh! Boy! I guess it boils down to this (at least for me); if you encounter a CHL holder who happens to be carrying
in your jurisdiction where the current law states that they should NOT be carrying,
would you 1) arrest; 2) suggest that they should NOT be carrying and that they need to do something with their
otherwise legal weapon; or 3) something else?
I really would like to hear what you believe your duty/response SHOULD be, and more importantly, WOULD be.

I for one am glad to hear that LE (SO or GW??) does actually make rounds at the Lake. We frequently spend time out there riding around on the lake during the week. I'm not all that happy about leaving my truck and trailer in a deserted parking lot nor walking up to it unarmed. Its not the most populated area , as are most CoE facilities. I'd much perfer to carry and be able to protect me and mine.....
Its a pain in the patootie (10 yr old rule in effect here ). I do wish that the CoE/Feds would recognize states' CHL holders' rights, but.... mabye in another life eh ?
