Lost My CHL...

I lost my plastic last weekend in New Orleans.... How do I get a replacement? Can I still carry?

For a quick answer before someone comes and cites some law, NO, you can't carry. I've been putting off reading my handbook but I know you can't carry without your license, no exceptions.

Edit: Unless of course you're carrying it in your glovebox, that's fair game just not on your person off your property.

I'm not an expert on the MPA, but I think it only requires that the handgun be "concealed from ordinary observation". Not necessarily in the glove compartment, and no restriction on having it concealed on your person while in or in route to a car you own or control.

Correct!

You can carry normally from your house to your car. The gun does not have to be concealed during the carry and could actually be in you hand if you want.

Once inside your car, the gun MUST be concealed. That means it can be in your glove box, under a dishrag on the seat or in your concealed carry holster on your person. But..........you cannot get out of the car with it on your person! If you get out of the car, you must first put it in the glove box or under that dishrag..........

Once you get to your business (or a place under your control) you can exit the car with it on your person and enter that location directly.

A powerful reason for having a Utah CFP (or some other state's non-resident permit) so that you can continue to carry pending receipt of a new copy of your CHL.

It is my opinion that if a person has a CHL they are not covered by the MPA. The law says we must have a license and display that license if we have a CHL so MPA does not apply to us if the LEO decides it doesn't. There is no penalty for not displaying a CHL any longer so good luck if you decide to carry. TDPS has the answers to your questions on their site so you can double check any opinion you get off the internet.

The recent law change removed the penalty for not showing your CHL to a LEO, it did not remove the penalty for carrying w/o the license(which he would be doing according to your opinion). He would beat the failure to disclose portion, but not the carrying w/o license charge that he would probably get.

I never suggested he carry without a CHL in hand and mentioned that the law was recently changed to remove the penalty. How do you get I was suggesting he do so out of "so good luck if you decide to carry"? I never mentioned the inflated internet rumor of being arrested for unlawful carry for a reason. Most people in most of the state will never run across that sort of harassment so further feeding the fire is not necessary in my opinion. That said, can you post what cities have put out warnings about arrests if a CHL does not have their license in hand? I think that would be an good thing for anyone who lives in or travels thru those areas to have and I can't find the information. I think I read some guy in the Dallas area was threatning it or maybe it was Houston.

Hm - what if you, say, lost your Texas CHL. Ordered a replacement. Received the replacement. Then found your original license? Are they somehow serialized so that the original is now invalid? Or could you keep it in the gunsafe as an emergency spare?

Lost wallet a couple of years ago, with CHL and DL in it.
Immediately reported both for replacements.
Wallet showed up in mail a few days later, with both CHL and DL in it,
only cash was gone.
Called DPS, said replacement CHL was being processed;
told me to destroy the old CHL since it was no
longer valid.
