My wife outed me

A few weeks back, I had to go to the ER. Had come down with Bronchitis, and was having some serious breathing diffacuties. Since it was tighness of chest, doctors were worried about a heart issue. While looking over some of the tests they had run, the doctor wanted my exact weight, and not the estimate I gave them. When getting ready to get on the scale, I asked how important the exact weight was, because I was carring af few pounds of "stuff" on me. At first he said no problem, then he asked me to empty out my pockets. Since we were out in the hall, I began looking for somewhere to step out of sight, and remove everything. My wife, seeing the bewildered look on my face, and proceeds to tell the Doc, "He had his Gun on him, and doesn't know what to do with it." :shock:

I am horrified at this moment, and look over at the doc to see his reaction. "Good, everyone should be carrying. Im taking my CHL next month" was his reply. :hurry: I was glad to hear it, but not in a very talkative mood, what with the trouble breathing and all. I was very glad to hear the Doc's going to get his, but need to discuss the "outing" with my wife.

After I thought about it for awhile, I was concerned about intentional failure to conceal. If a family member discloses that you are carrying in public, would that still be failure to conceal?

Anyway this one turned out ok, and it will hopefully be the last time it happens.

To answer your question, no I don't think her outing you would be considered a failure to conceal, unless she was using the satement as a threat. You do however have a bigger problem than that. :shock:

Lucky you didn't get in trouble, you probably walked by a 30.06 sign going into the ER. I haven't seen a hospital yet that doesn't have one on every door. :nono:


PC §46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE
HOLDER. (a) A license holder commits an offense if the license
holder carries a handgun on or about the license holder's person
under the authority of Subchapter H, Chapter 411, Government Code,
and intentionally fails to conceal the handgun.
(b) A license holder commits an offense if the license holder intentionally,
knowingly, or recklessly carries a handgun under the authority
of Subchapter H, Chapter 411, Government Code, regardless of
whether the handgun is concealed, on or about the license holder's
person:

(4) on the premises of a hospital licensed under Chapter 241,
Health and Safety Code, or on the premises of a nursing home licensed
under Chapter 242, Health and Safety Code, unless the license
holder has written authorization of the hospital or nursing home
administration, as appropriate;


That is found on page 40 of your Handgun Laws

It is amended on page 41 requiring them to post a 30.06 sign. I'd be willing to be there was a sign though.

Be very careful with that one. You don't want the trouble that can come along with it. You said ER , so I am assuming you weren't at a regular DOc's office which can be different.
Carry safe and carry when and where you can. I'm just sayin'.

Not all hospitals are properly posted.

The closest one to us has "State law prohibits..." posted on the doors. In other words, carry on!

:iagree: Emergency rooms often had police officers present - hospital police or security plus officers who are there on business because of followup for accidents, with mental cases, fight victims, drunks, etc. They could spot a CCW and you'd be in trouble. :nono:

Personally I don't think it would be worth the legal battle and expense to prove your point on that one just so you can carry into a hospital. Do what you think is best, I'll leave mine locked away. :tiphat: I'm too broke to waste money on attorneys. LOL

I dread being taken to an Emergency-room. Not just for the obvious reason of why I would have to go in the first place, but precisely because I am 99.9% likely to be carrying.

I am guessing (only guessing) that if I am "taken" to the ER due to a serious medical condition and I am not coherent (unconscious or just plain out of it), then even if it is posted 30.06, I would probably have a defense against prosecution.

However, if I am coherent, then I feel it is my responsibility to remove my weapon.

30.06 is required and there are many hospitals not posted. I carried into one twice this weekend while visiting a friend.

I suggest being gentle with your wife. She was also stressed and you were in the ER with potential heart troubles. Her focus was on you, understandably, and she was taking the most direct route to getting you what you needed. What a great first experience to learn from considering your doc!

I'd suggest offering other words to her. "Is there a place he can unload his pockets more privately?" "Honey, do you want to step into the bathroom first?" Whatever you would prefer. I think that a kind explanation of why and some appreciation for being there for you will probably be more than enough.

Correct me if im wrong but I always understood that the Hospital is one of many places that does not need to post 30.06?

Amusement parks, Hospitals, Shools, and establishments that gain 51% of profits from onsite consumption of alchohol.
