New Employee Manual, Just like a opinion
Just got this manual on Friday and I was glancing at it and came across this and would like a opinion on this statement on if I can carry or not! And/Or do I even ask the question if I can carry to the manager?
Unacceptable Activities
Generally speaking, we expect each person to act in a mature and responsible way at all times. However, to avoid any possible confusion, some of the more obvious unacceptable activities are noted below. Your avoidance of these activities will be to your benefit as well as the benefit of (company name). If you have any questions concerning any work are safety rule, or any of the unacceptable activities listed, please see your manager for an explanation.
Occurrences of any of the following violations, because of their seriousness , may result in immediate dismissal without warning.
Example of one of the items in question:
* Unauthorized possession of dangerous or illegal firearms, weapons or explosives on company property or while on duty.

That looks tricky. On one hand, you are authorized by the state of Texas to carry. Plus, a handgun is not an illegal weapon.
A baseball bat could be a dangerous weapon. So could an ink pen.
Asking for clarification may raise a red flag or two. Is there any posting on your building?
Did you sign for the handbook, you know the "I acknowledge that I received, blah, blah, blah..."?
It's just vague enough that I wouldn't carry, but I wouldn't ask because they might make the language more specific.

IMHO if you have your CHL your carry weapon is neither unauthorized nor illegal. I would say carry on, and remember concealed is concealed.

There is no posting on are on the inside of the building.
And no I have not signed this yet.
There is two of us that carry in this office and no one has told us that we could not carry! But again this rule was not in place at the time.

Seeking clarification from the company is unlikely to produce a favorable result. Currently, it does not rise to the level of "notice" required by 30.06 so licensed concealed carry is legal, and may or may not violate company policy. If you ask and they say CHL is OK, you gain only peace of mind. However, if you ask and they say no, that's oral notice and you would commit an offense by carrying at work.

Hmmmm
Are your firearms illegal, or in such disrepair as to be dangerous or explosive? Who knows what their intent is with the construction of that section.

well i worked for a medical school i kept my gun in my car all the time. but i never worried about them wanting to search my car. i just practiced never telling anyone i owned a gun or knew anything about them.

Legally, there's no problem here. Definitely don't ask anyone. What it comes down to is, you'll need to decide how much it's worth to you to carry. If you carry and are discovered, you might lose your job. If you don't and something happens, you won't be as capable of protecting yourself. I think that decision can only be made by taking into account your own personal situation. For example, losing a job might not be as big a deal for a young single guy than it would be for a man with a family to feed.

Play Joe Dunce about any knowledge of guns. Never tell anyone at work you're a CHL.
Make sure your concealment is good and carry at work.
It is NEVER advantageous to your purpose (wanting to carry at work) to ask anyone if it's OK.

The policy is telling you to NOT carry a weapon period, they will fire you if you are caught. its self expanitory they haven't authorized you to carry a firearm. all the rest of the stuff about well there is no 30:06 sign does NOT apply to employer/employee relations all the other theories are going to get you fired, there is no justification for violating the rules of employment and the rules indicate carrying or having a weapon on company property no matter if your a CHL or not is against company policy, sign or don't sign you are still resposible to obey the rules and conditions of employment. NO I do NOT agree with this type of policy but it is what it is.

No, it's telling him not to carry an "unauthorized [...] dangerous or illegal firearm". Ignoring the issue of who gives the authorization (because I'll bet the manual gives that information elsewhere), the quoted section does not comment on carrying safe & legal firearms (probably because whoever wrote it never conceived of such a thing).JP171 wrote:The policy is telling you to NOT carry a weapon period
Would I carry there? Dunno. It depends, in part, on how well I could conceal my gun, but mostly on how safe the area is and how much I'm liked by the people in charge of enforcing such policies. At my current company, we disregard certain policies all day long -- even some of the "insta-fire" ones -- because we know that they're stupid rules written by people who don't know what they're talking about. All the relevant bosses know about it and in most cases endorse it, so we feel pretty safe about breaking those particular rules. Carrying a gun is a funny one though. Even if the rulebook wording leaves it a bit of a grey area, you might get fired, rather than warned, just because people can be so jumpy.
I am not a lawyer, nor have I played one on TV, nor did I stay at a Holiday Inn Express last night, nor should anything I say be taken as legal advice. If it is important that any information be accurate, do not use me as the only source.

Defintely, do not talk about it or ask for authorization. It's not a 100% certainty that you will be told you cannot, but the chances of becoming authorized by your employer are extremely remote. That is something that could take time and getting close to those who would make that call to determine what their position is and if they would grant you authorization.
Since they haven't specified who is to give the authorization and as a CHL I am authorized by the state of Texas I would, at the very least, keep my weapon in my vehicle and seriously consider going ahead and carrying here if they were my employer.

The main words I look at are Unauthorized ( Which you are authorized by the state), and Illegal (which you have a CHL, hand guns are leagal for you to conceal).
