The article appeared to be slightly slanted. I doubt the people there have heard the last word.

I took a quick glance at the front page of that website and wrote it off as liberal nonsense.

I particularly enjoy this part: "Republicans claim the bill actually protects police officers, but what it really does is give paranoid gun toting anti-government nut jobs the legal ability to shoot any officer that steps in their home or on their property."

so if a police officer was beating someone senseless when that person was crying for mercy, you could use deadly force against that officer?

Interesting...the first article posted does have an obvious bias against the legislation and makes statements contrary to what the bill actually says. Thanks for posting the actual wording of the bill to clear it up. I think it's clear that no law enforcement group is going to be in favor of it, but I believe it does address valid concerns. There are regular occurrences of botched raids where a tactical team goes in hard...to the wrong house...in the middle of the night. Difficult to imagine how you'd react at 3:00am to the crashing sound of your door being kicked in and hearing multiple people running into your home yelling. I don't think the proposed law is intended to give homeowners a free pass to shoot at someone they KNOW is an LEO, but to give them protection in the case where they unfortunately wind up shooting an officer in situations where they haven't done anything wrong and are being assaulted by someone for an unknown reason. I have a relative who worked undercover narcotics in Houston...big, scary looking guy, usually dressed in grungy biker gear...and if I hadn't done anything wrong and saw him approaching me in an aggressive manner in a parking lot or on the street, I'd be on high alert and ready to defend myself if he didn't identify himself before he got too close. I DO foresee problems with it because in the case of a homeowner shooting at unknown intruders that are LEOs...the probable outcome is he will be killed when the rest of the team opens up on him, but if he should somehow survive, he would have a defense, and his family would have clear cause for civil action. :headscratch

It sounds like the person who wrote that article is high on drugs and/or clinically insane. Probably both.

If cops don't want to get shot, they shouldn't act like the bad guys. Putting on a mask and kicking down doors in the middle of the night is not "reasonable" search and seizure, no matter what some dope-smoking crazy people say.

er... I don't see how that law is bad. All it says is "if police officers illegally enter your home, you may defend yourself." I'm just glad that some legislators still remember the 4th amendment of our great constitution. Kicking in the doors with a mask on in the middle of the night while entering the WRONG house based on some crackhead "confidential informant" is NOT a reasonable search and seizure. That's a great law that needs to be passed in Texas, too.

Good police work is when they have done their homework and have EVIDENCE that you are guilty BEFORE they bust down your door. Lazy cops will kick down your door and then sort things out later. That's irresponsible and dangerous for both the officer and the homeowner. In no other profession does a professional base their actions on the say so of a crack head. Will your surgeon use a crack head anesthetist to do surgery? Will a fireman go to a house based on what a crack head tells him where the fire is? Why do police officers use crack head "informants" to tell them whose door to bust down?

I agree with you and the question of whether or not the police legally entered a home for which they had a warrant becomes critically important. Not too often, but often enough, we hear of a "no knock" warrant being served on the wrong house. Sometimes the officers serving the warrant go to the wrong house and sometimes the wrong address was typed on the warrant. As I've said in other threads, this is something I fear more than being caught up in a robbery. This could only end badly if my house were mistakenly entered by the police in a situation like this. All three of my dogs would likely be killed and possibly an officer and myself or my wife. And all because of a mistake. I would hope that a law like this will save citizens and LEOs lives by forcing the police to double or even triple check to ensure they have the right place before accidentally ending or changing someone's life forever.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

Your comment concerning the likely outcome is correct, but I would go beyond "POSSIBLY an officer and myself or my wife", to ALMOST CERTAINLY. How many accounts of a police shootout do you recall where a single individual fired on a group of police officers...whether he wounded/killed an officer or not...that he wasn't met with an overwhelming barrage of return fire from every officer on the scene? If you are opened up on by 4 or 5 guys, wearing body armor, armed with shotguns, pistols and possibly assault rifles, there's very little chance you're coming out of it alive.

And if you do survive the initial shooting, it's not unprecidented that EMS would not be allowed in until it's too late to save you. In the name of safety for EMS of course.

A while back, we had a cop here in Houston get shot when he broke down the door of a drug dealer. I have never thought it very safe for cops to knock down doors. You never know what's waiting for you on the other side. I find it much healthier for cops to take down a bad guy when he's away from home and not suspecting anything. Much healthier for innocent people who get confused for bad guys, too.
