Wouldn't walking out without paying be theft?

I am not a lawyer, but I don't think it's theft when you refuse to pay for something you never received. When you go to a Hooters, a large part of what you are buying is the ambience. The manager refused to provide that and if he expected full payment, that would have been a problem for me.

I would have told the manager that I was perfectly willing to leave, but I was not comfortable paying for something that I had not received. If he insisted on me paying, it would have been via credit card, with the words "under duress and threat of arrest" next to my signature. I would then have disputed the charge with the credit card company. Also, refuse any "to go" food since that is not what I ordered.

I realize that this is probably all of $20 at most, but it's the principle of the matter.

Anyways, I was enjoying my meal and watching the World series game when I was approched by the GM that was there. He asked if he could pull me to the side and ask me a question. Knowing what it was about I gladly said yes and followed him to the front door. There he explained to me that he saw a rather large buldge out of the side of my 2XL shirt and he realized it was a gun.

I am a little surprised that nobody else has commented on the line I colored in the quote above. Why/how did you know what he wanted to talk to you about? You seem to be taking the criticism well, so I don't want to harp on it too much. It just seems to me that if you knew what he wanted to talk to you about, then you knew your gun was not properly concealed and I'm curious why you sat in a restaurant knowing your gun was not concealed.

No. I didn't know that is wasnt properly concealed. Because I was sitting on a stool and adjusting myself frequently to make sure my shirt didnt slide up. But like someone else previuosly stated shirts tend to ride up depending on the seat you are in. I just have a 6th sense to stuff like this. Why else did he need to talk to me? Because I'm thinking when I got up tot use the restroom and I adjusted my shirt i accidently exposed it because of how I was sitting because when I came back is when he approached me. No one else "harped" on it because they knew the sistuationa and what I meant by it.

It's generally not a good idea to clue in the clueless when it comes to signage. That's what they pay their lawyers for.

Then what is the problem? Since, thats why I got on to this forum in the first place to see what would be better on my part to do next time and not to get an opinion on other places to have lunch/dinner.

I didn't go to into vast detail. Simply stated if you only want LEO to carry into your establishment look into getting the proper signs out front instead of having to stare down everyone.

The point is that now he knows there is a "proper sign", and now may take the effort to find out and ruin it for everybody else. Up to now only YOU were orally notified. If he subsequently posts the proper signage, everybody will be notified.

GT the more I think about your experience the madder I get. The manager must think he is some kinda kahuna to approach you and speak to you about what he assumes you may be wearing. If you werent causing any trouble or drawing attention to yourself he should take a flying leap. He was just wanting to flex his rinky dink "boss" authority.

I think I would have asked him just what the deal is....has he considered that I may be wearing an insulin pump, or other life support system? I would indignantly refused to discuss with him what I was wearing and that also includes the type of underwear I may or may not be wearing.

I would then tell him, if you want me to leave I certainly will, but before I do I want your name and your regional manager's name and phone number.

The problem is concealment. The Glock may be too large for you. I carry a smaller Sig .380. Yes, it is less horsepower, but it is totally concealable. I can put it in my jeans pocket, slacks, anywhere, and nobody knows. If you need more than a .380 inside Hooters, everyone is in trouble. Consider a P238 and never be bothered again by snoopy managers.
