Company Party Carry???

#1

Post by sobrnola »

My company is having their annual Christmas party in Seabrook Tx. The location is Di Amici Upscale Events. Just wondering if carrying there falls under the "if there is alcohol don't carry"? I don't drink and was just wondering y'all s opinion or the laws involved.

If it's not a valid 30.06 posted property, or TABC 51% posted...what you have under your clothes is of no concern.

No records found on TABC search for liquor, so it must be a bring your own I would guess, or something isn't working on the search.

If there is alcohol there, and you are not drinking, as it was said above, if it is not 30.06, carry away.

Does your company have any prohibitions on CC?
If yes, I would assume they extend to "company functions" as well.

Regarding this location.... It's possible that they don't have a liquor license and they allow their customers to hire a bartender or otherwise serve "their own" alcohol as a way of circumventing TABC licensing. Not sure how it works exactly in TX. Clearly the address is not listed in the TABC database or on Texas3006, so, I don't see any reason not to carry unless your company policy would prohibit it.

My opinion only... IANAL

The TABC license may be held under a seperate catering company name. If that's the case, keep your eyes open for any 51% signs.

I have literally combed through the handbook and no where does it talk about firearms. Period. So I guess I should be good to carry as long as there are no 51% signs or 30.06. Right?

What about weapons? Some companies will use overly broad terms such as weapons or deadly weapons.

If you search TABC using only the address, it comes back "no records found". As far as the TABC database tells me, there is no license issued to anyone at that premises.

Not sure if that is "conclusive" ?? :confused5

EDIT
Ok I finally found it. It is not under a specific header but under the employee code of conduct and substance abuse policy (what the heck) and it states my company has the right to discipline me if I am in the possession of a firearm on company property. It goes on to describe the different ways I can be punished if I am found to be concealing or possessing a firearm on company property. So that tells me that I'm a NO GO for carry at a company event, right?

Sneaky sons! This is probably one of those grey areas where if you're discovered they'll argue that the policy covers all company sponsored activities while your expensive lawyer would have to argue that the concealed weapons prohibition should not be extended off premises. Under CHL, you would normally be allowed to carry concealed there if it's not posted 30.06 or TABC 51%. If you do decide to risk it, take extra precaution to double-deep conceal.

mine has a no weapons policy while on the property, however at outside events we are allowed to carry.
I know this, as our HR guy is a gun guy, while he doesn't like the policy, he enforces it - on company property only, and off, he says carry away.
