Expired CHL Renewal?

expired on my birthday early this month. can i still renew? or do i need to start over again?
and yes, I realize i had six months, i just procrastinated.

You have up to one year to get your renewal paperwork in after expiration. You just can't carry on an expired license and must wait to get your new one.

And do it before Sept 1. After that, there is no grace period for expired licenses. You would have to complete the original application.

No grace period after Sept 1st, 2013?? When/where was this announced? I was about to mail my renewal in tomorrow, expired in July. I will do it anyway and see what happens.

It's part of HB 48.

 Sec. 411.185.  LICENSE RENEWAL PROCEDURE.  (a) To renew a
  license, a license holder must, on or before the date the license
  expires...

There is still a one year grace period for renewals. This is a rumor that got spread through a lot of the CHL instructors but is completely false 100%. If you are within the one year, you can still renew.

You are wasting your application fee if you do it anyway. They'll deny the renewal as invalid ($70), and then you are still stuck with going through the process as a new applicant ($140).

Remember that there are no fee refunds on denied applications.

Jumping Frog - please do not make absolute statements about things that you do not know. DPS has given conflicting information to both instructors and applicants. And, there are several examples of expired renewals who have, indeed, been able to renew their CHL's after September 1.

Tikibloke - you need to contact DPS, as they seem to be handling this on a "case by case" basis.

Me neither, but I am not a lawyer, and I don't work for DPS. And I don't have a crystal ball, or any special inside information regarding why they do the things they do, or how they justify them.

Grandfathered maybe?

Prior to Sept 1 the law stated you had 1 year grace period. If you are operating under that grace period then the Sept. 1 law is not effective/enforced. After Sept 1 all renewals not grandfathered have to be completed on or before expiration.

Not really any different than when I was in college and they changed the course requirements for my degree. Since I declared my major two years previous I operated under the previous degree plan. Anyone entering the plan from the year of the change had to operate under the new degree plan.

Just a thought of how it might be justified.

Contact the DPS and ask them before sending anything in.
