Perry to be investigated by special prosecutor
Found this link to Texans for Public Justice... A group out of Austin. I know nothing about them so I'm going to reserve my opinion of the said group until I do more research.

It's a strange situation. The Travis County DA was convicted of Drunk Driving but refused to leave office. The Public Integrity Division of the Travis DA prosecutes statewide for, among other things license violations and misconduct. So they get separate money from the state for that. Perry said that he couldn't see giving money to someone who had lost the confidence of the public. This is being pushed as Perry involving himself in a local issue, the Travis DA, but he was only talking about funding for a unit that handles State cases. Just as an aside the Travis DA's deputy was just arrested last weekend for Drunk Driving after hitting a car and injuring 2 people.

Innocent until proven guilty and all that but the idea that he ... I thought you lose your licence if you refuse to blow? That he would take actions that I know he condemns when he is in court disturbs me and that even if found guilty the DA doesn't think it warrants being fired, of course She doesn't since she did the same thing. The arrest affidavit says Grunewald appeared to have bloodshot eyes and smelled of alcohol. The officer also said in the report that Gruneweld refused to take breath and field-sobriety tests. Officers later drew his blood to test, after obtaining a search warrant.
Grunewald, who is assigned to the trial division which prosecutes DWI cases, was arrested and charged with DWI. He posted a $3,500 bond and was later released but ordered to install an ignition interlock device on his vehicle.

Who appoints a special prosecutor? What standing does it have? These guys are private with no authority to do squat. Where is the link to authority?

These groups seem to be popping up more and more. They're purely political and have no authority under law. I think the idea is to stain the target with the charge of investigation and indictment in order to influence voters into looking elsewhere for a candidate. There's a conservative group in Florida that has indicted Angela Corey, and some folks got all excited about it until they discovered it was as legitimate as Pamela Anderson's enhancements.

Kindly refer to http://online.wsj.com/article/PR-CO-201 ... 05033.html. I initially got taken in by this too in the Angela Corey "case." Some "citizens vigilante group" thinks it has the power to legally indict. That's what is happening here. Some group, with no power to do diddly squat, is acting like it is a government agency or something. Pee on 'em and leave 'em for dead.

They don't investigate they filed a complaint. It was finally assigned to a judge and he will be appointing a special prosecutor.JALLEN wrote:Who appoints a special prosecutor? What standing does it have? These guys are private with no authority to do squat. Where is the link to authority?
They original filed the complaint with Lehmberg’s office but since she is the DA in question she recused herself. It then bounced around the courts a bit before the presiding judge gave it to Richardson, a former state district judge, who is selecting a Special Prosecutor.
Re: Perry to be investigated by special prosecutor
It's not the same thing. They filed a complaint they didn't indite or pull some bull face political theater, they simply submitted a complaint to the DA that handles political corruption cases. Since the DA who handles such things is directly involved it got bounced around before landing with Richardson. They didn't pick Richardson, who is a former judge not a current one as I understand it so I don't get that, 3rd Circuit Presiding Judge Billy Ray Stubblefield assigned the case to Richardson. My understanding is the code of criminal procedure allows the "judge" or the presiding judge to appoint "any competent attorney" to prosecute when the states attorney is unavailable. Now I 'm sure I'm missing some detail in that legal analysis but it seems legal. When a prosecutor is appointed they will have to look at the evidence and then decide if there is even anything there to move forward on.The Annoyed Man wrote:Kindly refer to http://online.wsj.com/article/PR-CO-201 ... 05033.html.
