MI: Arrest for concealed weapon

#1

Post by cb1000rider »

I have some amount of interest in firearm laws and enforcement in MI for two reasons:
1) I spend some amount of time up there.
2) MI is an "open carry" state, so I look to see what that means in terms of public acceptance and general behavior.. Do note that the same "open carry" activists do stunts up there too.

I ran across this:
http://www.mlive.com/news/flint/index.s ... n_cla.html

I found it interesting as it's pretty much the opposite of what can happen in TX... Arrested for not being "open" enough about how he was carrying.
No it doesn't answer the question about why he was stopped (if he was concealed) and yes, the issue is solved by having a CHL (even one from TX)...

Looks like a ridiculous arrest to me.

It was clearly visible.

Made him sit in jail for Christmas day? Put me on the jury.

I would refuse to settle until I had several pounds of this officers flesh shaved off his hind side.

He could have avoided the whole situation if he had a license.

Most states do not require a license. In those states, any citizen can open carry unless they are disqualified from possessing firearms at all.

I open carried without a license over 20 years before I was even able to get a license.

I just thought it was interesting... Here, you get arrested if someone spots your firearm.
In MI, you get arrested if someone can't spot it...

States rights, I guess...

"Most"states do not require a license? How many? Which one?

So in over half the states one can open carry without restriction? Really?

It sounds like you need a license to carry concealed in Michigan, same as Texas. The difference is they allow open carry. Maybe one day Texas will too.
This is a Glock 40. Fifty Cent. Too Short. All of them talk about a Glock 40. OK?
I'm the only one in this forum fool enough - that I know of - to shoot himself with a Glock 40.

15 Gold Star states, no licencse required.
17 Friendly states. No license but some exemptions exist. Such as no state preemption so local legistration can restrict open carry.

I counted 14 Gold star states, 16 "Open Carry Friendly". Either way, we are both above half the states.

I'd phrase the "Friendly" states a little bit differently. Usually it means no license required, but there are some circumstances that are restricted, most commonly loaded guns in vehicles. For example, Michigan, Ohio, Pennsylvania, Wisconsin are listed as "open carry friendly" because unlicensed open carry is legal, however an unlicensed person cannot have a loaded firearm in a vehicle (it is considered concealed). Then you have states like Nebraska that are traditional open carry, but do not have statewide preemption, so cities are allowed to pass laws restricting open carry.

Idiot. Me that is. I counted by color, and counted both on the map and the list.
