It should be interesting to watch. If this gets into a courtroom, I'll bet some bleeding-heart jury finds against Horn and awards the families millions.

I get kinda discouraged when i see postings disrespecting Texas Courts and juries on this issue. I realize that it is possible, but I can't recall in the last dozen years or so any court case that a court and jury mistreated anyone in a self defense situation. I think that we read about bonehead decisions in other parts of the country and we project that on our great state. I believe that when mistakes are made in a self defense situation that doubt is given towards the argument of self defense. Even Robert Durst got away with killing his neighbor and chopping him up in pieces because he claimed self defense. I don't recall a jury ever granting an award to the family of someone killed in the line of a felony. I doubt that it will ever be commonplace.

The Jury would be drawn from the similar pool of Texans that made up the grand jury that no billed him. A Texas Jury would have been unlikely to to find for the defendant even before we had the castle doctrine. Its just not going to happen in Texas. We don't have Californian juries or Judges in Harris County or anywhere else in Texas that I know of.

Our Courts might be flawed in Texas, but accusations that we would actually pay of the families of those felons is almost slanderous.

No disrespect--just a guess at what could happen if this finds it's way into a court. The best thing that could happen is a summary dismissal.

I agree, but IMO this rarely happens.

I agree and hope that, in the end, this will go nowhere. The part that I find particularly abhorrent is that Joe Horn will still have to spend money to hire a lawyer to defend himself against this frivolous lawsuit. My wish is that lawyers be disbarred for filing such lawsuits.

Perhaps he will be able to recover his legal expenses from the families, but I doubt that will happen either.

I understand that, but I don't understand why most everyone posting in this thread seems to believe that the courts are likely to pay off Joe Horn. As I see it this is Texas and it just doesn't seem to happen here. Maybe there treason for such cynicism, I was hoping to flush it out so that I could understand.

The best thing that could happen is nothing. Which is what I believe has happened and will continue to happen. I don't believe this will be actively pursued. If I can't see any court certifying it. If that happened it would be very unlikely a Texas court would find for the plaintiff. We have no reason at all to believe that this would go to court and the family be awarded anything.

This thread has gone on for 3 pages and no one has challanged the idea that in Texas are ready to punnish Joe Horn. We should expect that he will be treated fairly. I believe a few posters are actually confusing Harris County with San Fransisco. I haven't seen any indication that courts in Texas are that generous towards the familys of those who commit felonies here in Texas. I

What lawsuit? The family may have mentioned suing, but so far there is no lawsuit, and no lawyer hired. Its possible the family will never be able to find a lawyer to take on this case.

I mean no disrespect to the Texas Courts nor their juries. On the other hand, that doesn't mean that I want to be a defendant in a Texas Court in front of a Texas jury.

Although it may seem that way, not every strange court case in this country originates in San Francisco. In this case, I was merely commenting on the possibility of such a lawsuit. It is equally possible that the family will be able to find a lawyer to take on this case. You do not know for certain that the family has not retained an attorney. There will always be lawyers who are willing to test the law to it's limit to win a case [or obtain a monetary judgement].

There have been threats made against Joe Horn, and I suspect he's still in quite a bit of danger. Is any type of crime victim's assistance available to him?

Several years ago, I attended a lecture on the profiles of the different types of sex offenders, and I recall the speaker telling us that various law enforcement departments offer services (mental health and/or legal assistance) to crime victims. However, the victims he was speaking of at the time were victims of sex crimes. Obviously, Joe Horn doesn't fit into that category; however, he's a crime victim nonetheless. Just curious as to what's being done to protect him.

Hope and pray that you never have to use :fire the concealed weapon that you have been licensed to carry. If you do use that weapon, you can be assured that you will be sued by someone - rightly or wrongly. In either event, there will be large legal fees :eek6 paid to the lawyers who put you in the position that you now find yourself. If you decide the legal fees are unjust, the lawyer will attach your income, property, etc. :banghead:
