I sure wish our neighbors to the west would clarify their resturant carry rules & post signs at the ones you can carry in.

Diners at a Garcia's restaurant in northwest Albuquerque lost their appetites after a customer attacked another inside the restaurant at lunchtime Sunday.
Police say Christopher Torres walked into the restaurant and saw another customer, John Garcia, sitting at a table eating with his family.
Garcia had a gun on his hip, in a holster. Torres saw this, announced to everyone that he was a DEA agent and said he had video evidence that Garcia was planning to rob the restaurant.
Torres then attacked Garcia, hitting him and trying to get the gun. The gun fell on the floor, a customer grabbed it, and then put it in the manager's office.
Other customers helped restrain Torres until police arrived.
Police say Torres suffers from mental issues. He was arrested and taken to the hospital for treatment. He will now face several felony charges.
Garcia was also arrested because he was not allowed to take his loaded gun into a place that sells liquor.

If NM prohibits carry into any place that sells liquor (I didn't read the NM law), then why would anyone need additional clarification before carrying into a restaurant that serves liquor?

My brother lives there and I visit him several times a year. We select our restaurants carefully.
You can carry in a place that is a package store (no on site consumption). Also you can carry in a restaurant that serves only beer and wine if it makes 61% of revenue on food. You can't carry in a restaurant that serves mixed drinks....that leaves most "successful" Mexican restaurants out since margaritas are required by natural law to be sold with beans, rice, etc.

I'll say it again, we are fortunate in Texas to have our clear cut 30.06 and 51% signs. Other places, not so clear.
BTW, did you notice the OC on the victim? Had he been CC, none of this would have happened...maybe.

In New Mexico it is illegal for non-LEOs to carry anywhere that sells alcohol unless they have a valid concealed handgun license and their weapon is concealed. If they meet those conditions they still can not carry anywhere that alcohol is sold for on-premises consumption. Additionally any sign, or verbal notice, can prevent legal carry as well. So in the article Garcia was Open Carrying at a location where alcohol is sold for on premises consumption, and he was carrying illegally CHL or no CHL.
Edit to add: Just looked at my NM notes, I think last year they may have amended the law so that you can carry in places that get 40% or less of their revenue from sales for on premises consumption.
