how does assault charge affect chl license?

last fathers day my 15 yr. old soon and i got into an alteration. without telling all the problems, he was on probation already and he was arrested for possession and i was arrested for assault. the court had me take a 6 week anger management course and dismissed the charge. i understood that an assault charge automatically suspended a chl license. although i never carried until after the dismissal, i never received any type of notification nor have to date. does anyone know how this affected the status of my permit? my lawyer seemed to think it didn't, especially with no written notification but it was my understanding, written notification out not, it was the permit holders responsibility to know their license was suspended until the charge was dismissed. if it was indeed suspended, how do i find out if it was reinstated? i would think the dismissal would have been recorded and my license reinstated but i know how paperwork sometimes gets lost in the shuffle and i would like to verify my chl is in good standing. any ideas?

I would call the DPS and see what they say. I don't think they have the status of your licenses on the website... unless the new website has changed that.

Call the TXDPS CHL office and ask them.

if you just looking for options it doesn't sound like it to me BUT domestic violence is a big red flag when it comes to a CHL. if the charges are dropped you are good. I had similar charges and they were dropped and I got my CHL.
Next time the cops show up and start telling you how to run your business point out you has the right to discipline your own kid and you will file a complaint if they violate your rights under Texas law. I have used this a couple of times when people want to get there nose in my business


PC §9.61. PARENT--CHILD. (a) The use of force, but not deadly force, against a child younger than 18 years is justified:
(1) if the actor is the child's parent or stepparent or is acting in loco parentis to the child; and
(2) when and to the degree the actor reasonably believes the force is necessary to discipline the child or to safeguard or promote his welfare.

In order for DPS to either revoke or suspend your CHL, the arresting officer needs to fill out a form and send it to DPS. If you look here you'll see the suspension and revocation forms (CHL-81 and CHL-88 respectively). If the arresting officer doesn't do that, then DPS usually won't find out about the issue.

Now, this does NOT speak to what might happen if you were to use deadly force under conditions where your CHL "should have been" suspended. (Or other troubles that bring the issue to light.) Most likely your lawyer would have to work it out. You might want to have the court documents showing that the charges were dropped before contacting DPS about this. (Not deferred adjudication.)

thanks for all replies. needless to say its been almost overwhelming all that has gone on. my son has always been trouble since he was in grade school. its been compounded by my wife taking his side where its me, teachers, or the law. i never in a million years would have thought she would be like that but she's lied to me and not been truthful to the school and his probation officers. he started off with adjudicated probation and blew that within 4 weeks. since then he's been i'm detention and different programs but has no respect for adults or authority. I've always tried to do right, had never been arrested or been in the back of a police car. it was quite an ordeal and its still going on. i took great pride that i had a good record and a chl so it really bothers me all that has happened. anyway, guess we just gotta keep putting one foot in front of the other.

just to be clear, the charges were dismissed. I think the court may have figured out the charges should never have happened but by that time id already been arrested and pushed through the system. actually the class they had me take was an 8 or 12 week class that they only required me to do 6 weeks. i wanted to take it to trial but my lawyer said just take the dismissal. i think the difference was a dismissal would have erased the arrest but the dismissal will mean the charges were dropped but the arrest will be on my record. my lawyer said e could get it expunged after 2 years.

I, too, was worried about the domestic violence aspect, but if the charges were dismissed then it will, hopefully, be a moot point and you won't have any problem with a CHL.

While everything is fresh in your mind, I would suggest getting several certified copies of your court documents and disposition of your case.

I have a couple of buddies with two sons each. In each family, one son is a good kid, the other is nothing but trouble. One of the sons threatened his mom with a knife, on drugs, can't hold a job, etc, the other miscreant would steal his father's tools and pawn them probably for drug money. Go figure.

As hard as it is to do after you have done the best you can for as long as you can, you have to let them go on their own and hope for the best! Especially after they threaten a parent with a knife. :shock:
