I think a "warning shot" could be a nail in your coffin. "Your honor, if the defendant truly feared for his life then why would he waste time with a warning shot, giving the assailant more time and opportunity as well as escalating the seriousness of the situation in stead of diffusing it."

Whose leg did you have in mind for that "warning shot" - yours or the antagonist's?

That "vertically into the sidewalk" shot might well produce the same results.

While warning shot tactics in any shape or form may sound good after a few beers at a meeting of the local armchair commandos club, there are lots of non hypothetical good reasons why armed professionals don't engage in these practices. Many of these have been discussed at length in other threads on this forum.

I just looked up 'warning shots' on a police forum and it appears that y'all may know more about the advisability of 'warning shots' than I do.

That said, I hope I never have to face a shoot or don't shoot situation in real life. If one shoots one, one will have to explain one's actions to His/Her Honor and perhaps 12 of one's peers - sooner or later and that won't be cheap.

I commend you for not just taking some of the members' word (my own included) for the advisability of warning shots, and for taking the initiative to find other reliable sources to confirm or negate what's been said. That's the reasonable man's approach to making sure his beliefs are well grounded, and not just based on the last thing he read or heard.

The fact of the matter is: none of us are going to know what we're going to do until we do it. While every situation of this sort is the same - they are all different. For example, Gun Rule No. 4 - Be sure of your target and what's beyond it. One can not be over prepared for such encounters and one must be situationally aware at all times. Afterall, the life you save may be mine.

When carrying a semi-auto, there is only one round you can really count on, and that's the one in the pipe. Why would you waste it in the air or dirt, risking a malfunction that could take you out of the fight... permanently?
