Prior to the castle doctrine, the law said that you had a duty to retreat, if that was possible, before defending yourself.
Also prior to the castle docrtine it was also possible for the BG or the BG's family to sue you for shooting/killing them in civil court. I never understood that, you break into my house and I shoot you defending my family and then you or your family can come back and sue me?!!!

In fairness though, one of the things that almost defeated the "Castle Doctrine" in Texas was the fact that the proponants had a tough time demonstrating the need, because these types of suits almost never happened. The legislators should good sense in passing the bill to ensure that it is even more unlikely.

Criminal defense attorney Jeff Blackburn was on TV last night saying the castle doctrine is a bone headed piece of legislation that will result in more shootings and was pandering to the gun lobby.
Jeff Blackburn must be affraid his client base might die up....err I mean Dry Up. He might have to go into Tax law or Personal Injury...
