So you have to meet the standard of insanity to be found "not guilty by reason of insanity," but merely having your judgment "impaired" is sufficient to reduce the classification of murdering an infant from capitol murder (death penalty or life in prison) to a state jail felony (6 months to two years in jail).

Jessica Farrar,the bill's primary author, is also the woman who filed HB1395 that would make legal hunting a defense to prosecution, meaning every hunter could be arrested and prosecuted and they would have to hire an attorney to prove the defense of lawful hunting. So she would have lawful hunters to jail for killing a dove, but only have a murdering mother spend 6 months to two years in jail.

Who is this woman and how did she get elected in Texas - of all places? The problem is not Jessica Farrar, the problem is her constituency and her supporters/followers in the legislature. It's not illegal to be a whacko, but the voters should know better than elect whackos to speak for them unless, of course...er, uh, well, you know, the voters themselves are whackos.

BTW, my little rant has nothing to do with freedom of choice.

I don't think this is about abortion. It appears to be worded specifically to reduce the sentence of women who suffer from postpartum depression/psychosis and murder their child as a result. This would only apply in a very specific circumstance; not to anyone/everyone who murders a child.

I agree with Charles though. There is already a standard for "insanity" which should be applied in these cases.

I guess I can see where this is coming from, but I think it makes no sense, whatsoever. If the mother is insane (due to post-partum depression or whatever) then she'll be found not guilty by reason of insanity. If she is/was not insane, then she knew that what she was doing was wrong, and she should face the full penalty for her illegal actions!

To give all victims a right to equal protection under the law, they also should delete #1 and #9. Maybe other special cases too.
