I have a similar situation. My plan is to refuse the search and call their bluff, especially if (as I expect) they are searching only my car and not the entire parking lot. It's still MY car even if it's on their property. They may be able to fire me over it, but they are treading on very thin ice in doing so IMO. If I allow the search and they DO find what's under my seat, they will have confirmed cause to fire me and I consider the refusal of a search to be the lesser of the evils by far.

It happens occasionally in the refineries and chemical plants...enough so that on opening day of dove hunting there will be as many trucks parked outside the gate as inside. No one wants to take a chance. Otherwise I'd expect it to be a rare occasion...only as a result of a problem.

I've never personally been involved with it, but friends have.

Sorry for a late reply to an old-ish thread. My plan, should my employer want to search my car is to say that my wife dropped me off that morning, and I do not have a car in the parking lot. They won't find the car keys in my pocket without a personal search, which isn't going to happen, and without those, how would they know if you actually have your car parked there or not ? HR doesn't keep a record of licence plates per employee, and there is nothing on my car that identifies it as mine, if I say it isn't.

However, in a controlled lot (permit) they DO have a record of your plates.

My employer has searched vehicles and has fired people. They have called bluffs when someone said if you search my truck, you have to search everyone. They searched everyone's vehicle and ended up firing one or two more people. This only happened once or twice, but they had no problem with terminating the employees. Most of my managers don't want to have to deal with it. The one or two actual incidents involved someone ratting out other employees to the boss and forcing his action.

In informing us of the policy, the company freely admits it is not illegal to have a gun in your car in their parking lot, but they reserve the right to fire us if we violate policy. They also say that refusing a requested search is also grounds for firing. What sucks to me is that our corporate office uses a 3rd party parking garage, but they still say the policy extends to that parking area also.
