I'm pretty sure they can't do it without enabling legislation. The handgun reporting requirements are a '68 Gun Control Act thing.

Doesn't mean they won't try, but it will only give Congress more of a push to reign in the rulemaking powers of the executive agencies.

Then why isn't the NRA asking to contact our legislators instead of the DOJ? Also, This is for semi-auto long guns, not handguns. I believe they have the power to do this without congress. All the White House said was that it wasn't an "emergency" and public comment was required. Just like with the FAA, with whom I dealt for years, when they propose a new rule, they put out an NPRM (Notice of Proposed Rule Making) and then make the final rule after the comment period. I could be wrong, but if it required congressional approval, the NRA, as they usually do, would be asking us to contact our legislators not the DOJ.
