If you knew that you wife was just cheating, I agree 100%. Since he thought his wife was being attack/raped, I think I would have possibly had a similiar reaction.

I think you'd only be justified in shooting the scoundrel if he refused to take her with him when he left...or if he tried to bring her back at a later date.

Before Rockefeller got the law changed, in NY it was said that the only way to get a divorce in NY was to prove adultery, and the only acceptable proof was to have it occur in front of the judge. There also used to be "alienation of affection" laws in several states, which could justify to sue, jail, or even shoot.

No, your buddy is wrong. That would be murder. Your buddy is probably thinking about that famous court case where the man walks in on his wife having sex with another man. She panics and yells, "rape". The husband shoots and kills the other man. The court declared the husband innocent of murder because the husband really thought that his wife was being raped. The wife, however, did get a small amount of jail time and/or community service (I forget what). The point is that his wife got a slap on the wrist and the husband walked. The wife corroborated her husband's alibi that he really thought she was being raped. Even though she was cheating on him, she testified FOR her husband. Funny thing is, after the wife got out of jail, the two get back together again. Well, I guess it's not so funny if you're the other guy....
It is because of this court case that many misinformed people think that you get a free pass for murder if you shoot your wife's extramarital lover caught in the act. I don't think very many guys can count on their CHEATING wife testifying FOR the husband. That's what makes this case so unique. The case I'm thinking of is different from the case that
