Let's expand our question:

The gun you just found was in the toilet in a Rest Area on the Interstate about half way between here and there. As far as you can tell, there's no one else in the immediate vicinity.

Now, what would you do?

If I did not have a CHL it would take a little more thought. Not wanting to leave it unattended I would probably wait for another patron to visit the restroom and ask him to contact the police for me and tell them where I was and that I needed them. Then I would be sure to keep my hands out of my pockets and in sight, separated, as I awaited their arrival.

You'd probably be OK if you weren't in one of the 46.03 prohibited areas. However, you would give yourself a greater margin of safety by calling the situation in to 911 so the circumstances are on tape to prevent any misunderstandings later.

1)hand it over to local LEO
2) Post a note that an item was found, the owner has to contact local PD to identify it and claim it.

Part of me would think "SCORE"! The wiser side of me would be afraid the gun had been used in a murder or something. I would call the Highway Patrol and wait for them to arrive. I wouldn't touch the darned gun...just in case it was used to take out Hoffa.

Thank goodness none of us found the gun that was stashed for Michael Corleone. :mrgreen:

Really? I've often wondered what I'd do.

If it had tape on the grip and visible file markings, etc., I'd treat it like it was a copper tailed rattlehead. OTOH, if it was a nice compact 1911 like mine or something, it might just be 'finders-keepers' time. I dunno'...
