You are correct that this one might be filed. But, if it was an accident as stated, then the intentional part of the law is not met.AEA wrote:How about failure to conceal?srothstein wrote:If a CHL could legally have the gun where the ICE agent did and forgot it in the bathroom, what charges would you bring against him?
Sorry, I am not familiar with that law. Which code section are you referring to?How about failure to control?
This is always a possibility, even for people who are not breaking the law at all. I was really asking about the law, not the abuse thereof by the police.I'm not saying that the CHL would be convicted, but in reality I think an overzealous Cop could come up with all sorts of "charges" for the CHL to "take the ride".

Re: I.C.E. Agent
Failure to Control most likely is not a Law.
What I meant by that is loosing control of your weapon, thus allowing anyone who comes across it to take it.
If that is not a Law, then it should be. Teenager in the restroom picks it up. Convicted Felon on Parole in the restroom finds it and takes it, commits a robbery and kills someone.
Those types of things is what I meant by Failure to Control.
Maybe I should have said something like "Endangering Public Safety"?

Re: I.C.E. Agent
Thanks AEA. I could agree that we might need to look at a law covering situations like this. My point was that it is not currently against the law, other than the failure to conceal might be.

I know situations like this are disturbing, but I would bet he won't do that again. I really don't think we need to come up with new laws. Don't the ones we have cause enough problems already?
