Sorry you had to do it----never easy, at least not for me. I would have done it whether it was on my property or not, couldn't just let it suffer.

As has been stated no need for chl on your own property.

If the question did come up as the animal was not ENTIRELY on your property, IIRC there is a law allowing a sworn officer to enlist the help of a citizen. Couldn't find it.

I don't think there's any problem. I talked with a guy last summer who has a suppressed .22 pistol. The local police know he has it, since they had to sign off on his permit. They've called him several times to put down injured deer that were struck by motor vehicles for exactly the same reason Flintknapper states: They have to fill out beaucoup paperwork if they fire their weapon. Also, the suppressed pistol didn't cause the neighbors to become alarmed. These incidents were definitely not on his own property.

I had a similar thought on a recent trip returning to Houston from OKC about a wounded deer on the side of the road (whether or not I hit the deer is unimportant).

For the record, I did NOT hit a deer or actually see one flailing about on the side of the highway.

Could I put the animal out of its misery using my concealed weapon? Like a lot of you wrote, I couldn't stand to see it in extreme pain and misery. How would you handle such a situation?

No, I know that....I should have been more clear. Its just that for a few moments I was actually a few feet off of my property talking with the officers (prior to dispatching the animal) and then once again as I walked around the animal to position myself for the best shot. I'm dead certain neither officer was thinking about property lines or easements and we weren't IN the road...just partially in the "easement".

I could have dragged the animal a few more feet COMPLETELY onto my property and there would have been no issue for certain, but it was already in enough pain.

This is a very interesting question, I'd love to hear other's thoughts.

As to whether the person would be in legal problem, I suspect it would depend on if the authorities used common sense or not. For the person doing the shooting it would be much like using your gun to defend someone else. Is it worth the possible legal expenses and ramifications to do the good deed?"

I think this logic applies and would be acceptable in about 80% of Texas, but PRA (Peoples Republic of Austin) or PRH (Houston) I'm sure would crucify such a do-gooder.

If you use a rifle you can avoid any uncertainty about handguns and CHL. Maybe have a quicker and more merciful kill too.

...I agree from what I've heard of both places...and I didn't say I'd always stay around and take credit for the shot...

...wouldn't I make a possum cop's day if he drove up to find me standing over a deer with a hunting caliber rifle...there goes my guns, my truck, and my next few months' salary...I assure you that what I carry to defend myself will do the job quite mercifully...

...yup, but my experiences with game wardens are that they look at someone with a loaded rifle as hunting...instead of dispatching a suffering animal on the side of the road...I made my point earlier...argument is over...
