why oh why is the name of this thread so wrong??? an M-16A1 is NOT a machine gun, it is a select fire RIFLE, geez now were not only killing puppies but kittens too.

Ya know? Your'e right. The one time they can accurately use the term "assault rifle" and they up the ante to "machine gun."

That makes it legally a machine gun, according to a law that passed when Stoner was a pre-teen.

actually it doesn't make it a machine gun, it may make it a class 3 weapon but not a machine gun

True, but I think he means that legally there is no distinction.
possibly, the law doesn't define a difference in title 26, however there are physical distinctions between a select fire rifle and a machine gun

This thread has gone the way of people who argue the term clip and magazine, when they know what the other person meant.
A M16A1 generally meets the definition of a Machine Gun.
A machine gun is a fully automatic mounted or portable firearm, usually designed to fire rounds in quick succession from an ammunition belt or large-capacity magazine, typically at a rate of several hundred rounds per minute.
By the way...An M2HB meets the general definition of select fire rifle.
A selective fire firearm has at least one semi–automatic and one automatic mode, which is activated by means of a selector which varies depending on the weapon's design.
And the LAW makes no distinction between the two.
machine gun is a technical term for any fully automatic firearm, and also for any component or part that will modify an existing firearm such that it functions as a fully automatic firearm.
