I don't really have a problem with this practice. Sure, it smells bad, but, the NYPD is not breaking any laws.
If I lived in NY, I would encourage my police force to use all legal means to protect me from another terrorist event.

If NYPD feels that the FBI and other Feds are not doing everything that needs to be done, they have a vested interest in seeing to it themselves. So long as those actions are legal.

I already have more reasons to dislike Bloomberg than I need for a lifetime. This one is not going on my list.

Of course, YMMV ;-)
New Jersey Attorney General Jeffrey Chiesa has said he's seen no evidence that the NYPD's efforts violated his state's laws.

In only this country was still under the rule-of-law, we'd have the pleasure of seeing Bloomy arrested, tried, and imprisoned.
