Went to TX Ren-Fest this weekend & couldn't find ANY sign - 30.06 or otherwise.

OK, I see the law and I can even see the entire facility being considered as premises due to the layout. But wouldn't a 51% sign still be needed at the entrance? There wasn't one the last time I went (2009 or 2010) and I seriously doubt they derive 51% from the sale of alcohol. Based on what I have observed and from discussions I would expect it to be more in the 25% range.JP171 wrote:Sections 11.61(e) and 61.71(f) of the Alcoholic Beverage Code
An offense still occurs if the concealed handgun licensee is on the premises of a business that has a mixed beverage permit, a private club registration permit, a wine and beer retailer’s permit or a beer retailer’s on-premise license if the business derives 51 percent or more of its income from the sale of alcoholic beverages for on-premise consumption.

My apologies. I thought you were saying the CHL was committing a crime, when it appears you were actually saying the private club could lose their TABC license, temporarily or permanently.JP171 wrote:Sections 11.61(e) and 61.71(f) of the Alcoholic Beverage Code

The wet/dry county and private club is not regulated by TABC, it is a city or county thing. The stickers you have are probably mandated by the county regulations on how a private club is allowed to sell alcohol and what type. While the county may consider the festival as a private club, TABC only licenses the individual establishments at the festival at the state level, and as such that is what controls the gun restrictions on their part.JP171 wrote:yes Scarborough Ren Faire is posted, the faire is in a dry county so therefore to be able to consume adult beverages it falls under the laws as a private club that makes 51% from onsite consumption. I have several club stickers on my camera case so I can have a brew or 2. Also it is in the TABC Database as a 51% location
I went this year for the first time and saw the 30.06 on the ticket windows booth. I didn't have my CHL at the time so I didn't pay too much attention to it, but it looked legal.Waco1959 wrote:OK, I see the law and I can even see the entire facility being considered as premises due to the layout. I don't recall seeing a 30.06 sign but there is a 30.06 notice on the website under weapons policy. Since I doubt most people would read the website they would still need signs. IIRC someone did say SRF did have 30.06 signs up.
Personally, I agree about the SRF not being classed as one premises but I can see where a legal argument could be made. As for revenue, my 25% is a very generous %. After you account for ticket sales, vendor fees, and food sales I would be surprised if alcohol was more than 10% of revenue but you never known how things are structured as far as who claims what revenue.Jaguar wrote:I went this year for the first time and saw the 30.06 on the ticket windows booth. Also, I can't see SRF being a 51% facility for the whole thing. There are tons of shops and only a few places where alcohol is served, and those were not doing gangbusters business when I looked. I would say overall, 25% is very generous, maybe more like 10%.
Between my wife's shopping and my one beer, it was more like 1%, YMMV.
