People can and do post all kinds of garbage online and send threats by e-mail. Mostly they are just cowards who have nothing better to do.

However, I read another article (which I don't conveniently have a link to) where one of the Houston TV stations interviewed the relatives of the deceased driver, and it was your basic "pure as a newborn lamb victim of injustice."

The medical examiner issued a preliminary report that the driver's death was a homicide and that he was intoxicated at the time. Also there was doubt about whether he was the driver or passenger. Now they are pretty sure he was the driver.

I'd have a pretty hard time convicting a parent for killing a drunk driver that had just killed their children. If the guy was driving drunk and killed two children he got what he deserved, whoever shot him.

Whoever shot the guy did not have time to perform a sobriety test or to determine that the children were dead (one wasn't, at the time). That's kinda why we frown on vendettas and lynchings nowadays.

Most people involved in an injury accident try to help the victims and call 911. The few that can't do that are probably having panic attacks.

Whatever happened in this case was pretty weird, if the whole story can be pieced together.

Yes, we have the benefit of hindsight --though maybe he was very obviously drunk and/or said something inflammatory. I wouldn't do it myself, and I'm not advocating such action for the very reason you illustrate (he didn't kill anyone, but years ago a guy ran off the road and hit a transformer across the street from me.....not drunk....had a seizure). However, if I was sitting on a jury and a parent was on trial for killing a drunk that killed his children, I'm not sure I could vote to put that parent in prison. OTOH, I'm sure I'd be asked that question in the jury pool so I doubt the prosecutor would let me on the jury.

if it was a grieving father that shot a drunk driver that killer his kids they better not get me on that jury because I will be pushing jury nullification.

Emotionally I know where you're coming from, but you probably would not get onto the jury except by lying and doing a good job of it. If they suspect that "jury nullification" is even in your vocabulary, you can forget about it.

Part of jury selection is swearing to uphold the law as directed by the judge in the specific case.

The law does provide for "sudden passion" killings, but it means possibly downgrading murder to manslaughter and reducing the sentence.

BTW, I've been dismissed from jury panels maybe six times out of seven. I didn't keep count. I have been on the jury on one civil case.

Innocent lambs generally don't drive drunk and kill kids, but what can we expect from a criminal's family except denial?

Some will defend and support their family members no matter what, but there are exceptions. The Unabomber's brother gave the decisive clue that led to identifying him. I'm sure there are other examples that I can't think of at the moment.

I was puzzled as the Corvette wreckage looked survivable. Then I noticed the driver did survive, but returned to the car after leaving and was hit by a hit and run driver who abandoned his pick up truck on foot.

As a Juror you have the right and obligation to rule on truth and law. This is a check and balance. This is just as important to protecting ourselves against the tyranny of the state as the 2A. Our rights do not come from government, the government is in existance to protect rights.

Sorry, hadn't looked at the thread in a while. We surmised that it bounced off the ilium and traveled up piffing his innards. He was face down when we arrived, still warm and displayed profound dependent lividity of the abdomen.

At least he was headed in the right direction. ;-)

The father of the kids killed while pushing his broken down truck has noow been arrested in the killing of the other driver
In December, a family was hit by tragedy, when two boys helping their father push a broken down pickup were killed, struck by a drunk driver. Now the father has been charged with murder, over the single gunshot wound to the head that killed the driver responsible for his sons' deaths.
