In any case, unless the student had the firearm "in a locked container, or a locked firearms rack that is on a motor vehicle", then he is guilty of violating the GSFZ. I'll be interested in seeing if the Feds go after him for it or if the state tries to claim he's guilty of something else.

My guess is there will be no legal charges, but a exuplsion from school will occur.

my understanding is that a political subdivision of the state may indeed make laws or ordinances, school districts are political subdivisions of the state as evidenced by the district police, they do take parents and children to JP's courts under the FOB Local those are infact written by the school districts, so umm just like a MUD can make an ordinance/law about things within the MUD District concerning the use and appropriation of the natural resource of water and so forth as in taxes so can a school district and they do. it takes the state legislature to stop them. so yep its laws. but basically the student did violate the gfsz act under the fact he had a weapon that wasn't either under a CHL or locked in a safe or locking rack

Please point to me in the government code or educaiton code where a school district has the capability to make its own laws. I don't think you will find it.

NBC Houston just said all charges have been dropped against the student....reason being the "parking lot is not part of the school"

After what happened with the teacher in Houston so recently, the arresting officers cops in a Houston suburb have no excuse for not knowing the law about unloaded firearms in a vehicle trunk or toolbox. In a world with any justice, they would be sued personally and the student would win enough to pay for four years at the most expensive college in the country. Let's see if there's any justice left in the Texas courts.

And I did walk up hill to and from school in the snow. My house was on one hill and my school was on another hill. However, it was only about one mile away, not 5. But, alas, I did not take a gun to school.
