I keep the entire contents of my wallet scanned, including passport, filed on my phone and archived at home. Be sure and scan/photo both sides of your credit cards so you have the numbers to call in case your wallet is lost/stolen.

Does handing your phone to an officer give consent to review the contents? Logic would suggest "Look at this here picture" only grants access the single picture displayed. But I could it being seen as "He put his phone in my possession with permission to view its contents."

The law to have insurance info on your phone (don't know if it passed) had language that specifically prohibited an implied consent to search the rest of the phone. Also, the bill's sponsor was opposed to having DL on the phone because of "security" issues. Presumably he would feel the same way about CHL.

That or just carry the documents as required..that and don't have child porn on your phone!

My phone is pretty boring. Unless the cop likes looking at pictures of "whats for dinner" , pets and my trees, they are going to get pretty bored...LOL.

Obviously, that is not legally sufficient. But 99% of police officers are reasonable in those circumstances unless I have already acted in such a manner as to have them earnestly searching for reasons to arrest me.

I've never really understood that. LEOs have access to your DL data, CHL data, and data about your license plate registration.
Assuming you had enough to establish a positive identity, why make a big deal about not having the plastic as long as it checks out?

I know that sometimes women forget their purse...but guys forgetting their wallet?? Wearing sweats with no pockets?

I really appreciate the discussion. I guess it comes down to the LEO. Yes, in best case don't forget but I think I'll make good photo copies of both just in case I forget again. It does happen from time to time.

People driving on suspended driver's licenses like to present copies of their license thinking we will not run a DL check . I have forgotten my ID before. I still carried because it was a simple mistake.

My understanding is, in Texas, if you are detained that LEOs consider the phone part of what is on or about your person. They can take it and search it.

However, if you were to have the phone locked and password protected, for some reason that requires a greater barrier to search (warrant). (Not included in the above reference)

Note, where exactly this is going to land is still be sorted out in the courts. Assume that if you hand it over, willingly or not, and it's not password protected, it can be searched.
