not in Houston..... I was talking to a patrol office the other day (taking down my report of my tires and wheel being stolen off my truck in my driveway) and he was telling me how bad the DA and the system is around here. He referenced a call he was dispatched where a homeowner saw a man in his backyard on his security camera from his phone so he called 911. the officer gets there and catches the guy with a screwdriver and a backpack trying to pry open the back door. he was arrested and the first question the DA asked was "can you prove his intent?" are you kidding me? a screwdriver and a backpack in the middle of the night trying to pry open a door????? not to mention video evidence of the guy hopping the fence and prying at the door and they ended up letting him go for unconclusive evidence :shock:

now if this same situation would have been different in where the owners were home and prepared things might have been a little more conclusive. but since there was no body then they had bigger fish to fry.

The DA should be charged as an accessory to whatever crime this guy subsequently commits.

Give the DA a break. He is only looking out for his conviction rate.
