In those states you don't need a license to legally carry a handgun, so an expired license isn't still "in effect" in terms of avoiding criminal prosecution.

I agree, but it's irrelevant. BATFE makes a blanket decision whether a State's license is NICS exempt or not.

That was done. In fact, I worked with BATFE and FBI attorneys for 6 months to get an agreement to let DPS access the NICS database without becoming the POC for all firearms transfers in Texas. After working on this for months, we learned that DPS was already doing this. To be clear, I didn't contact BATFE again this session on this issue; it was discussed as part of our negotiations on other CHL issues for the 2009 session. CHL licenses weren't being issued for months and we were working on several legislative fixes, some of which touched on NICS exemption.
