You have the right to remain silent, unless you're asked a question at a checkpoint.
Seriously, they're going to stop whomever tickles their fancy for whatever reason.

If a DUI stop is "legal" - I really don't have an issue for testing for other *currently intoxicating* drugs. I do have an issue on the legality of a "stop everyone" stop.

A "little" violation of the constitution is still a violation of the constitution. That's how we got where we are with the 2nd amendment.

BTW, this is really going to upset the whole "medical" marijuana crowd. I wonder how long they will still test positive? I know from employer drug testing that it takes a couple weeks to clear the system.

The problem I have with this is the potential for abuse. The presence of a legally prescribed drugs in your system is not an offense. Driving impaired is an offense. You can have detectable amounts of some drugs, legally prescribed and used, long after there is any impairment, days and even weeks after using.

So that's what I don't get. The tests for impairment are the same. There isn't a special "pot" test.
If you're impaired, you should be arrested and then blood tested to figure out the cause.
If you're not impaired, why do we have to keep snooping around?
