You are misreading it. DPS explained it and made it clear during instructor renewal. It is on their website

A person who submits an application after expiration can renew up to one year afterwards.

Alright, drop the snide comments about DPS.

Like I stated, I am positive they have checked with their legal department and are solid on the interpretation.
