Sec. 9.32. DEADLY FORCE IN DEFENSE OF PERSON.
(a) A person is justified in using deadly force against another:
(1) if the actor would be justified in using force against the other under Section 9.31; and
(2) when and to the degree the actor reasonably believes the deadly force is immediately necessary:
(A) to protect the actor against the other's use or attempted use of unlawful deadly force; or
(B) to prevent the other's imminent commission of aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery.
(b) The actor's belief under Subsection (a)(2) that the deadly force was immediately necessary as described by that subdivision is presumed to be reasonable if the actor:
(1) knew or had reason to believe that the person against whom the deadly force was used:
....
(C) was committing or attempting to commit an offense described by Subsection (a)(2)(B);

Engaging in a fire fight in a restaurant with one or more aggressors is about at the top of the list of nightmare scenarios for me. There are a lot of innocent bystanders around (even late at night at a Denny's) and little if any good cover available.

I've pretty much made a it a point to not put myself into situations like this....i.e. going out to eat at late night restaurants. I'm not saying I haven't done it or won't do it, but I remain very cautious and ask to sit at the very far back and facing the front door. Additionally, I've also made it a habit to have my important documents like my TXDL & CHL and insurance identification cards in a seperate wallet, basically anything that has my address on it, so if forced to give up my wallet all they have is CC that I can call and cancel and the security that they don't know where I live.
On a side note, my father-in-law, on the way back from Galveston from a wedding late night told me he had to take a piss. I was smack dab in the middle of downtown Houston and I told him to hold it long enough b/c I was stopping anywhere at a gas station or similar at midnight. I did have to eventually stop b/c I'll be damned if he pisses in my brand new truck
However when we did stop at a restaurant I dropped him off and drove off until he was done, I did not park sitting there waiting.
