To me that would be the best path. You technically have no record so why disclose anything. If there is a question you have the paperwork to explain why you didn't report it.

If it has truly been expunged, then it does not legally exist and the person can deny the existence. So, if the expungement does meet the same guidelines as Texas, which to my untrained eye appears it does, then it would not have to be put on the application.

That said, the arrest, expunged or not would not be a disqualifier as it is past the 5 years. The main thing is if you do decide to list it you need to send documents along showing that the disposition of the conviction and that it was expunged.

So, you get to make a decision to not list it and see if they kick it back or request more info if they find it on your record, or list it and send the supporting documents. Either way you should be eligible if there are no other disqualifiers in your history.
