This is Texas, everyone knows rustlers should be hung from the nearest sturdy tree.

Doubtful as the law is pretty clear. Between the fact it was night and the fact he had no expectation that the property could otherwise be recovered he'll probably beat the charge even if he is indicted.

I mean, that's an awful lot of hassle to go through, you need a rope, a good tree... Samuel Colt and John Moses Browning didn't work so hard for you to reject their inventions and keep adding unnecessary difficulty into your life, you know?

A good lawyer can bring up clearance and recovery rates for auto theft in Harris County (or all of Texas) as justification of “property cannot be recovered by any other means”.
The stolen vehicle recovery rate (including all vehicles such as motorcycles and ATVs) was 4.8% for all of Texas in 2017 according to the Texas Auto Theft Task Force. Based on that, a reasonable person would say that his stolen truck would be gone for good if he did not intervene.
