What determines when the threat has ended? Taking a knee? Laying down on the ground but still moving and still have a gun? Not breathing?

What is the appropriate number of rounds to fire? Is there a standard number less than a magazine?

In the case of the pharmacist, he reloaded from behind the counter, walked over to the bad guy on the ground, stood over him for a headshot. Very different than this case.

Looks like to me the perp was still moving a bit and holding his pistol (or at least no evidence he wasn't holding it) when the clerk started firing his last string of shots. This was all part of the same event, it wasn’t like the Oklahoma pharmacist who walked away, and then came back and THEN finished off the robber.

That's what I was thinking. It did look like he was still moving when he started that last string of shots.

The clerk did the right thing and I'm happy they didn't press charges. Now if he would of walked over the top of the body and continued to empty more rounds into the guy then this would be a little different. Although I think it would put more fear into these thugs if you were allowed to??

In that case, presumably he would have been charged with mishandling a corpse. :shock:
